Economic stimulus: Allocation to Transport and Technical Services for Victoria Avenue phase 3

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Economic Stimulus Plan: budget allocation to the Transport and Technical Services department for the delivery of the Victoria Avenue Phase 3 project.

Decision(s):

The Minister approved the allocation of £2,307,000 to the Victoria Avenue Phase 3 project, which will be transferred to the department budget as soon as possible. This will enable the construction contract to be let to the contractor which submitted the preferred tender.   

He further instructed the civil infrastructure project group to report on spend of all stimulus monies, and project progress/performance, on a monthly basis in accordance with guidelines set by the Treasury.

Reason(s) for Decision:

A discretionary fiscal stimulus allocation from the Stabilisation Fund of £44m has already been approved. The project meets the key criteria for fiscal stimulus being timely, targeted and temporary and will benefit local business and individuals. The £2,307,000 allocation to the project will enable the civil infrastructure project group to let the contract and deliver the scheme in accordance with the critical path.

Resource Implications:

No financial resource implications other than those explained above and in the accompanying report.

No manpower resource implications.

Treasury to be informed of decision to release necessary funds to the Transport and Technical Services budget.

Allocation of fiscal stimulus funding to Victoria Avenue Phase 3 Project  

14 th December 2009  

Background  

The highway condition survey undertaken in October 2007 highlighted Victoria Avenue as a route needing essential repairs. It is a class 1 route with over 12,000 vehicles travelling in each direction per day and has strategic importance as the priority route between the Airport and St Helier.

This project is the third phase of Transport and Technical Services (“TTS”) planned resurfacing, realignment and renovation of drainage and lighting of Victoria Avenue. The works will also improve safety and access to car parking.  

Phase 1 was funded via the Capital Programme for TTS and is now complete. Phase 2 was funded with £1m from the TTS Capital Programme and £1,143,452 from the Discretionary Fiscal Stimulus Programme. 

Purpose of this paper  

The Tenders have now been received and evaluated for Phase 3 and the tender evaluation undertaken by TTS has been subject to review by the Fiscal Stimulus Steering Group (the “Steering Group”) to ensure that the Fiscal Stimulus criteria continue to be met. This paper summarises the resulting recommendation.  

Tender Process and Results  

TTS has followed a pre-determined process in conducting the tender which they confirm to be compliant with Financial Directions and Procurement Principles for the Fiscal Stimulus Programme. The process and outcomes have been subject to review by the Steering Group, which has resulted in the recommendation below.  

TTS will contribute £600,000 to the full costs of this project. 

Recommendation from the Fiscal Stimulus Steering Group  

The Steering Group recommends that the Minister for Treasury and Resources allocates funding of £2,307,000 to the Victoria Avenue Phase 3 project and approves the transfer of that amount to a new capital head of expenditure.
