Crematorium: Proposed charges for 2014

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Proposed Crematorium and Associated Charges for 2014.

 

Decision(s):  The Minister requested the Treasurer of the States to approve a proposed 10% increase in cremation charges, and a 2.5% increase in Book of Remembrance charges and Memorial Cards charges. The proposed increase to take effect from 1 January 2014.

Reason(s) for decision:

Fuel costs have increased by over 11% in the past two years, but Crematorium charges have been increased only by 2.5% each year in line with the RPI. The proposed increase in charges beyond RPI is due to the significant increase in fuel costs - going up by 4.6% in 2012 and 6.5% during 2013. The running costs for the Book of Remembrance and Memorial Cards have increased by 2.8% in the past year. However, the department is only seeking an increase to charges of 2,5% to keep in line with the RPI of the 3rd quarter 2012.

Resource Implications:

Charges for cremation will rise by 10%, whilst charges for Book of Remembrance and Memorial Cards will increase by 2.5% from 1 January 2014. There are minimal administrative tasks to carry out but no resource implications.

 

Action required:

  1. To request the Treasurer of the States to approve the amended fees as set out in the attached schedule
  2. On receipt of that approval, to instruct the Law Draftsman to prepare the necessary Order.

1                    Background

 

1.3             The Crematorium charges for 2013 were approved by Ministerial Decision ref. MD-HSS-12-0038 (copy attached Appendix A).

 

1.4             From 1st January 2013 the cremation charges were increased by 2.5% and the book of remembrance and memorial cards were increased by 2.5% in line with RPI.

 

2                    Present

 

2.3             The Minister is now required to approve charges for 2014 for an Order to be drafted under the ‘Cremation (Jersey) Law 1953’.

 

2.4             It is recommended an increase of 10% is added to the present cremation charges and 2.5% for book of remembrance fees and cards for next year.

 

2.5             It is therefore recommended that cremation charges are increased from £615.00 to £676.50, an increase of 10%. Increase in the charges of 2.5% for the book of remembrance and memorial cards are detailed in the tables below.

 

3                    Recommendations

 

3.1 Cremation fees:

 

The Minister for Health and Social Services approves the fees as set out below under the provision of the Crematorium (Jersey) Law 1953.

The Minister is recommended to request the Law Draftsman to arrange for the preparation of the necessary legislation to give effect to the variation in the fees from 1st January 2014.

 

3.2 Books of Remembrance and Memorial Cards:

 

The Minister is further recommended to approve the following charges for the Book of Remembrance and Memorial Cards which have been increased by 2.5% rounded up to the nearest 5p: -
