2009 Law Drafting Bid - Transport and Technical Services.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  1. Approved the law drafting bid for 2009 in relation to legislation specific to the Driver and Vehicle Standards section of TTS; and
  2. Noted the current status of items already allocated law drafting time including the carrying forward of time allocated for amendments to the Road Traffic/Motor Traffic Laws

Reason(s) for Decision:

  1. The bid is required to ensure both driver and vehicle safety within the Island is maintained.
  2. The delay in debating the Integrated Travel and Transport Plan has delayed the requirement for law changes relating to buses, parking charges and taxis.

2009 LAW DRAFTING BID AND STATUS ON CURRENT ITEMS IN LAW DRAFTING PROGRAMME  
 

Purpose of the Report  

To seek the Minister’s approval to the 2009 law drafting bid for Transport and Technical Services and to note the deferment of one item in the current programme. 
 

Background  

The Law Draftsman wrote to the Department in December 2007 seeking an update on current law drafting items already allocated time in the programme and also requesting bids for 2009 to be submitted by 29 February 2008. 
 

Comments  

  1. There are currently five law drafting items within the current programme with time allocated to TTS. The following items are all in progress:

 

  1. Road Traffic Law amendments relating to parking tickets.
  2. Consolidation of Traffic Orders relating to signs, speed limits and pedestrian crossings.
  3. Amendments required to Road Traffic legislation to conform to Human Rights (as identified in audit undertaken by Law Officers).
  4. Streetworks Law – final proposals being developed and law drafting instructions will be issued this year.

 

  1. There is one item allocated time in the 2007 Law Drafting Programme that TTS wishes to maintain but carry forward to 2008/09. These were law amendments of the Road Traffic and Motor Traffic Laws stemming from the Integrated Travel and Transport Plan which has yet to be debated in the States.  The time relates to legislation particularly related to buses, changes in car park charging mechanisms and also the regulation of taxis.

 

  1. There is also one new bid for 2009 which relates to items identified within the TTS Business Plan specifically in the Driver and Vehicle Standards section. Within this area, there are a number of items of legislation that will require updating to ensure vehicle and driver safety is maintained, as follows:
    • The Registration Law has not been reviewed for some time and this needs to be updated.
    • There is pressure to change the current restrictions on size and type of vehicles allowed on the Island’s roads to ensure EU compliance and adequate supply of commercial vehicles due to the growing lack of availability of narrow width commercial vehicles on the market.
    • The current debate relating to seat belt restraint may require greater legislation changes than an Order.

 

A completed and signed Law Drafting Bid is attached to this report at Appendix A. 

  1. Also attached at Appendix B is a completed Bid Prioritisation Form. As there is only one bid in 2009, the priority is clear and it has been rated as Highly Desirable (HD) as opposed to Essential or Desirable. This form also asks for indications of 2010 and 2011 law drafting bids. TTS is currently unaware of any potential requirements for these years.  This form has been signed by the Chief Officer and requires the Minister’s signature.

 
 

Recommendation 

The Minister is recommended to: 

  1. Approve the law drafting bid for 2009 in relation to legislation specific to the Driver and Vehicle Standards section of TTS; and

 

  1. Note the current status of items already allocated law drafting time including the carrying forward of time allocated for amendments to the Road Traffic/Motor Traffic Laws.
