A & E Radiology Extension (Phase 2) - Approval of drawings

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

In accordance with paragraph 1 (d) of Standing Order 168, the Minister approved the drawings numbered 4520 / L02 / -, 4520 / L87 / -, 4520 / L89 / -, 4520 / L92 / - and

4520 / L88 / A, all showing the proposed alterations and extensions to the Accident & Emergency and Radiology Departments at the General Hospital.

 

In accordance with Financial Direction 3.6, the Minister approved a request from the Minister for Health and Social Services to reprioritise and transfer existing capital funding from the Crematorium Gardens Extension capital vote JZ0065 (£327,752.00) and from the Tube System Extension Vote JZ0079 (£567,164.00) to the Accident & Emergency Department / Radiology Extension Vote JZ0063.

 

Reason(s) for Decision:

The drawings have planning approval (Permit P/2007/3078 refers) and were approved by the Minister for Health and Social Services on 25 July 2008 – Ministerial Decision MD-HSS-2008-0036 refers.

 

The drawings reflect the use for which funds were allocated in the 2006 capital budget, however, the latest cost estimate indicates that the project, as designed, is over the allocated budget sum (including estimated allowance for inflation held in the Capital Reserve). Accordingly, to support this shortfall, the Minister for Health and Social Services proposes to reprioritise existing capital funding to permit the tender process to proceed. The Treasury will review the financial position once the tender process has been completed.

 

Property Holdings recommends approval of the drawings.

Other than those detailed in the report there are no further financial or manpower Implications.
