Budget transfer: Central Contingency funding for Brighter Futures 2014 deficit

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Brighter Futures 2014 deficit funding  - Contingency draw down

Decision(s):

The Minister approved a non-recurring budget transfer of £13,886 from Contingency in 2016 to the Chief Minister’s Department (CMD) revenue head of expenditure in accordance with a decision taken by the Council of Ministers on 30 October 2013.

Reason(s) for Decision:  

Article 17(2) of the Public Finances (Jersey) Law 2005 states that the Minister for Treasury and Resources is authorised to approve the transfer from contingency expenditure to heads of expenditure of amounts not exceeding, in total, the amount available for contingency expenditure in a financial year.

 

The Council of Ministers in their meeting on 30 October 2013 agreed to provide funding from Contingency to Brighter Futures to support its continued operation in 2014 and 2015. (Report no 1446/1(95)). The decision taken by the Council of Ministers was an exceptional decision made in light of the charity’s reported funding difficulties, which the charity is committed to resolve through the appointment of a dedicated Executive Officer.

 

The Chief Minister, in accordance with the COM decision has requested that the Treasury Minister approves the transfer of £13,886 from Central Contingency in 2016 to support Brighter Futures in covering its 2014 funding shortfall.

 

The Brighter Futures annual accounts (signed by their Board in December 2015) show a funding shortfall of £13,886 for 2014. The budget transfer of £13,886 from Contingency in 2016 would enable a grant of the same amount to be made to Brighter Futures to cover the 2014 shortfall.

 

It should be noted that £13,886 is significantly less than the anticipated shortfall.  

Resource Implications:

The CMD revenue head of expenditure would increase by £13,886 in 2016 and the Central Contingency would decrease by the identical amount.  This amount will then be paid as a grant to Brighter Futures.

Action required:

Head of Decision Support to notify the CMD Finance Manager and the Director, Social Policy that the decision has been approved.
