Road Traffic (Speed Limits) (Jersey) Order 2003: Amendment: Law Drafting Instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision: To amend the Road Traffic (Speed Limits) (Jersey) Order 2003 to lower speed limits on certain roads where the proposal has the support of the Connétable of the Parish and is consistent with current Policy.

 

Resource Implications: Law Drafting time will be required as well as £10,000 from the Department’s revenue budgets for the installation of the required signage.  Each Parish will be required to fund the signage where signs are erected on Parish by-roads.

 

Action required: Acting Senior Engineer to instruct the Law Draftsman to prepare an Amendment to the Road Traffic (Speed Limits) (Jersey) Order 2003 for subsequent submission to the Minister.

AMENDMENTS TO THE ROAD TRAFFIC (SPEED LIMITS) (JERSEY) ORDER 2003

 

 

Purpose of the Report

 

To amend the Road Traffic (Speed Limits) (Jersey) Order 2003

 

 

Background

 

There are a number of outstanding requests to lower the speed limit on various roads on the island.  A review of these requests has been undertaken in line with the Island’s current Speed Limits Policy using the current Island Plan proposals map to define the “built up area” for the purposes of that Policy.  The review has identified a number of locations where it would be appropriate to lower speed limits.

 

The proposals have been discussed with the Connétable of each of the Parishes within which the changes are proposed, and a public consultation was held during July 2013.  Following this consultation the extents of the proposed “Trinity Village” 30mph have been extended.  Limited adjustments to the proposed changes have been made in other locations.

 

A further consultation was held on proposals for an extension to the 20mph speed limit in St Mary during August 2013. 

 

An extensive consultation has also been held for various improvements to St Aubin.  A 20mph limit on the main road passing through St Aubin Village has been included as a direct result of that consultation.    

 

 

Discussion

 

Following an assessment of various requests to lower speed limits on certain sections of road and an extensive public consultation process, it has been determined that it is appropriate to amend the Road Traffic (Speed Limits) (Jersey) Order 2003, so that speed limits are lowered on the following sections of road. (For clarity the proposals are listed by Parish).

 

The creation of two new Green Lanes with a speed limit of 15mph has been approved by a St Mary Parish Assembly.

 

St Brelade

 

A reduction to 30mph on:

 

  • La Route Orange from La Rue de la Sergenté to Le Clos des Sables, including approximately 150m on La Rue de la Sergenté prior to its junction with La Route Orange.
  • La Rue de Genet from La Petite Route des Miélles to La Route de Noirmont.

 

 

A reduction to 20 mph on:

 

  • La Petite Route des Mielles for the entire length from La Rue de Genet to La Route du Francfief.
  • La Neuve Route from Charing Cross to a point corresponding to the northern boundary of the Church of the Sacred Heart.
  • The entire length of Charing Cross.
  • Le Mont les Vaux from Charing Cross to a point 50m north of Chemin des Piétons.

 

St Helier

 

A reduction to 20mph on:

 

  • Rue de Trachy from Mont Cochon to La Route de St Aubin.

 

St John

 

A reduction to 30mph on:

 

  • La Rue de Saint-Jean an extension of the existing village 30mph zone from approximately 33m west of La Route du Nord to approximately 95m west of La Rue du Cimitière.

 

St Mary

 

A reduction to 30mph on:

 

  • La Rue de la Vallée from the junction with Rue de la Rosière for a distance of 130m north and for a distance of 45m south.
  • La Rue de la Rosière from Rue des Buttes to La Rue de la Vallée.

 

A reduction to 20mph on:

 

  • La Route de St Marie from the junction with Rue des Buttes to a point 125m west of the junction with La Rue és Viberts.
  • The entire length of La Rue des Buttes.
  • La Rue de Bel Air from the junction with Rue des Buttes to the junction with La Rue des Landes.
  • La Rue de la Vallée from La Rue des Buttes to a point 130m north of the junction of La Route de la Vallée with La Rue de La Rosière.
  • La Rue de L’Église south of La Verte Rue.
  • The unnamed road between La Verte Rue and La Route de St Marie.
  • La Rue de la Rosiere between La Rue des Buttes and La Verte Rue.

  • La Rue de la Pointe from La Grande Route de Saint Pierre to Rue de L’Église.
  • Rue des Niemes from La Rue de la Pointe to approximately 104m north of La Rue de la Presse.
  • Petite Rue de la Pointe from La Rue de la Pointe to Rue de L’Église.
  • Rue de L’Église from approximately 36m south west of La Route de l’Hermité to approximately 15m south of La Rue de la Pointe.
  • La Rue des Fontaines from La Rue de la Pointe to approximately 25m west.
  • La Grande Route des Augerez for approximately 45m in advance of La Grande Route de Saint Pierre.

  • Part increase from 20 to 30mph, part reduction to 30mph on A12 La Grande Route de Saint Pierre from approximately 26m north of La Rue des Sapins to approximately 90m north of La Grande Route des Augerez.

 

St Peter – Beaumont Area

 

A reduction to 30mph on:

 

  • La Route de Beaumont from approximately 20m south of Rue du Craslin. (existing 30 mph sign) to approximately 35m north west of Clos de Bauche.
  • Le Vieux Beaumont for approximately 45m in advance of Rue du Craslin.
  • La Ruelle és Ruaux from La Route de Beaumont to approximately 70m north east of Le Mont des Vignes.

 

A reduction to 20mph on:

 

  • Rue du Craslin from A12 La Route de Beaumont to Sandybrook Lane

 

A reduction to 30mph on:

 

  • A12 La Route de Beaumont from approximately 20m south of Rue du Craslin (existing 30 mph sign) to approximately 35m north west of Clos de Bauche.
  • Le Vieux Beaumont for approximately 45m in advance of Rue du Craslin.
  • La Ruelle es Ruaux from A12 La Route de Beaumont to approximately 70m north east of Le Mont des Vignes.

 

A reduction to 20mph on:

 

  • La Rue du Craslin
  • Les Grupieaux from La Rue du Craslin to Sandybrook Lane.

 

Trinity

 

A reduction to 30mph on:

 

  • Rue és Picots from approximately 170m east of La Rue du Carrefour to La Route de la Trinité.
  • La Verte Rue from La Rue és Picots to a point approximately 20m south of the junction with La Rue du Carrefour.

St Saviour

Conclusion

 

Amending speed limits on the sections of roads detailed above is consistent with the Island Plan and has the support of each the respective Connétables. The proposals have been extensively consulted on and while there have been some objections the proposals have generally been supported, and in some cases the areas subject to change have been extended in response to feedback received.

 

 

Recommendation

 

The Minister is recommended to approve the proposal to amend the speed limits across the Island as detailed above.
