Listing of Furze Cottage, St. John.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister for Planning and Environment determined to:

1. approve the proposal to include the building and places at Furze Cottage, St John on the List of Sites of Special Interest by reason of its special interest as defined in the schedules attached to the report, under the provisions of the Planning and Building (Jersey) Law 2002; and;

2. approve the serving of the Intention to List Notice for this sites in accord with the requirements of the law.

Reason(s) for decision:

The proposal accords with the States Strategic Plan commitment of protecting and sympathetically managing our built heritage assets.

Action required:

1. Intention to List Notice to be served in accord with the requirements of the law;

2. No sooner than 28 days after the date of the service of the Intention to List Notice, a further report will be brought back to the Minister relative to any representations received.

Notice of Intention to List as Site of Special Interest

Furze Cottage, St John

Purpose of the Report

The purpose of this report is for the Minister to consider a proposal to include Furze Cottage, St John on a List of Sites of Special Interest under the Planning and Building (Jersey) Law 2002 and to authorise the serving of a Notice of Intention to this effect.

Background and discussion

On the basis of its special interest, Furze Cottage was added to the Register of Buildings and Sites of Architectural, Historical and Archaeological Importance in Jersey as a proposed Site of Special Interest by the Minister for Planning and Environment on 13 March 2006.

As a pSSI the building and place presently enjoys protection under planning policy set out in the Island Plan 2002. It is considered that the special interest of this property warrants a higher level of protection and, in accord with the decision previously made, it is considered that the process to protect this property under law, thus providing more comprehensive regulation and protection, should be expedited.

Recommendation

On the basis of the above, the Minister for Planning and Environment is recommended to;

approve the proposal to include the building and place at Furze Cottage, St John on the List of Sites of Special Interest by reason of its special interest, as defined in the attached schedule, under the provisions of the Planning and Building (Jersey) Law 2002; and;

1. approve the serving of the Intention to List Notice in accord with the requirements of the law.
