Gender Recognition (Jersey) Law 2010 (Appointed Day) Act 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Chief Minister agreed that the Gender Recognition (Jersey) Law 2010 (Appointed Day) Act 201- should be lodged au Greffe as soon as is practicable.

Reason(s) for Decision: 

1. This Law is to provide for the legal recognition in Jersey of changes in gender by transsexual people so that they may enjoy any rights conferred by the law of Jersey on people of their acquired gender.

2.       This Law will bring Jersey into compliance with the Island’s obligations in relation to legal

          recognition of changes in gender pursuant to the European Convention on Human Rights (the

          “ECHR”).

Resource Implications:  There are no financial or manpower implications for the States arising from the adoption of this draft Act.

Action required:  Request the Greffier of the States to ensure that the draft Act is lodged for approval by the States at the earliest opportunity.

DRAFT GenDER RECOGNITION (Jersey) Law 2009 (Appointed Day) Act 200-

REPORT

The purpose of this Draft Act is to introduce the Appointed Day Act for Gender Recognition (Jersey) Law so that it comes into force one month after this Act is made.

 

Background

 

This Draft Act is the final step in implementing the Gender Recognition legislation – a law that is to provide for the legal recognition in Jersey of changes in gender by transsexual people so that they may enjoy any rights conferred by the law of Jersey on people of their acquired gender. 

 

This Law will bring Jersey into compliance with the Island’s obligations in relation to legal recognition of changes in gender pursuant to the European Convention on Human Rights.

 

Legal recognition will follow from the issue of a full gender recognition certificate (a “full certificate”) by the Royal Court.  Before issuing a certificate the Royal Court must be satisfied that the applicant has been recognised under the law of an approved jurisdiction as having changed gender.

 

Financial and manpower implications

All departments which will be affected have confirmed that financial implications are minimal.  There are no additional manpower implications.

 

Explanatory Note

This Act would bring the Gender Recognition (Jersey) Law 2010 into force one month after this Act is made. The Gender Recognition (Jersey) Law 2010 was adopted by the States on 3rd February 2009 (P.174/2008).

THE STATES, in pursuance of Article 23 of the Gender Recognition (Jersey) Law 2010, have made the following Act 

1 Commencement of Law

The Gender Recognition (Jersey) Law 2009 shall come into force one month after this Act is made.

 
2 Citation

This Act may be cited as the Gender Recognition (Jersey) Law 2010 (Appointed Day) Act 201-.
