Policing of Roads (Jersey) Regulations 1959: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister agreed to amend the Policing of Roads (Jersey) Regulations 1959, as requested by the Connétable of St Helier.

 

Reason(s) for Decision: To enable the Parish of St Helier to improve its policing of roads, in particular for the control of dog fouling.

POLICING OF ROADS (JERSEY) REGULATIONS 1959

 

 

Purpose of the Report

 

To amend the Policing of Roads (Jersey) Regulations 1959 to introduce an article describing “Authorized Persons”.

 

 

Background

 

The Connétable of St Helier has requested that a description of an “Authorized Person” be added to the articles in the Policing of Roads (Jersey) Regulations 1959 to enable the Parish to improve its policing of roads, in particular for the control of dog fouling.

 

 

Discussion

 

Under Article 2(d) of the Policing of Roads Regulations, permitting any animal to foul a footpath is already a prohibited act.  However, in order to improve the powers of the Parish to control this offence the Connétable has requested that a similar Article to Article 8 of the Policing of Parks (Jersey) Regulations 2005 be added to the Policing of Roads Regulations to enable personnel within the Parish’s Community Support Team  (“Authorized Persons”) to have some power to  deal with the problem of dog fouling on roads within the Parish.  Article 8 of the Policing of Parks Regulations states that: -

 

(1)    A park authority must issue each authorized person it appoints with an identity card that 

(a) contains the name of the authorized person; and

(b)   states that the person is an authorized person for the purposes of these Regulations.

(2)    If an authorized person believes that a person has committed an offence under these Regulations the authorized person may, after showing his or her identity card to the person, require the person to give his name and address.

(3)    A person who fails or refuses to comply with a requirement made under paragraph (2) or who gives a false name or address shall be guilty of an offence and liable to a fine of level 2 on the standard scale.”

The Minister is recommended to approve the request.
