Customs and Excise (Jersey) Law 1999: Disposal of Vehicle

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Disposal of vehicle used to import controlled drugs into Jersey

 

Decision(s): The Minister authorised this vehicle to be disposed of as scrap.

 

Reason(s) for Decision: The vehicle, having been used to import cocaine, herbal cannabis and cannabis resin into Jersey on 25 January 2019, was seized on 11 February 2019 under Article 54 of the Customs and Excise (Jersey) Law, 1999.  Article 55 of the Law empowers the Minister to direct how any vehicle condemned as forfeited is disposed of.

Subject: Disposal of Ford Mondeo, registration EN05 JXT

 

 

Background

 

On 25 January 2019 the above vehicle was used in connection with the importation into Jersey of 87.16 grams of cocaine, 1.86 kilograms of herbal cannabis and 1.94 kilograms of cannabis resin with a maximum total street value of £94,000.

 

The vehicle was seized by the Customs and Immigration Service on 11 February 2019 under Article 54 of the Customs and Excise (Jersey) Law, 1999.  No notice of claim has been made in connection with the seizure and the vehicle is deemed to have been duly condemned as forfeited in accordance with the 3rd Schedule of the 1999 Law.

 

Article 55 of the 1999 Law empowers the Minister to direct the manner of disposal of the vehicle.

 

The Mondeo was first registered in June 2005 and has in excess of 113,000 miles on the odometer. The vehicle is in poor condition throughout. A representative of Driver and Vehicle Standards has attended and examined the vehicle and provided the opinion that it is worth less than £200.

 

Recommendation

 

In light of these circumstances, the Minister is recommended to direct that the Ford Mondeo, registration EN05 JXT, is disposed of as scrap.
