Restriction on Smoking (Advertising, Promotion & Display) Jersey Regulations: Draft: Amendment (P.17/2013): Lodged 'au Greffe'

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved an amendment to the Draft Restriction on Smoking (Advertising, Promotion & Display) Jersey Regulations (subordinate to the Restriction on Smoking (Jersey) Law 1973) and decided to proceed to lodge the amendment ‘au Greffe’.

Reason(s) for Decision:

This amendment allows the existing policy objective to be met, whilst enabling the Island to continue to meet its existing obligations under the UN Convention Maritime Law.

  • There are no additional manpower implications as a result of this amendment

Action required:

The Greffier of the States to be requested to arrange for the draft Amendment to be lodged ‘au Greffe’ for consideration by the States Assembly in due course.

DRAFT RESTRICTION ON SMOKING (ADVERTISING, PROMOTION AND DISPLAY) (JERSEY) REGULATIONS 201- (P.17/2013: AMENDMENT)

 

 PAGE 30,   REGULATION 29

(a) after Regulation 28, insert the following Regulation –

“29 Application of Regulations to the territorial sea

These Regulations do not apply to a vessel of any description that is within the territorial sea, adjacent to Jersey.”.

(b) Renumber the existing Regulation 29 as Regulation 30.

REPORT

 

There are currently no local Regulations in Jersey that control tobacco advertising and promotion. The draft Restriction on Smoking (Advertising, Promotion and Display) (Jersey) Regulations 201-, which are similar to equivalent legislation in the UK and Guernsey, would prohibit the advertising and promotion of tobacco and also prohibit the practice of point of sale display.

 

This amendment enables the original policy objective (requiring all vessels who sell tobacco, operating into and out of Jersey, to be subject to the same requirements set out in the Regulations, as apply to onshore retailers) to be met when a vessel is in internal waters (including harbours), whilst having regard to Jersey’s international obligations under the UN Convention on the Law of the Sea.
