Concerning certain protection measures against foot-and-mouth disease in the United Kingdom (Order No. 2)
Purpose of the Report
It is proposed that the Planning and Environment Minister makes an Order implementing the European Union Commission Decision of of 9 August 2007
concerning certain protection measures against foot-and-mouth disease in the United Kingdom and repealing Decision 2007/552/EC (Draft Order attached). This Order would revoke The Diseases of Animals (Foot and Mouth – Restrictions) (Jersey) Order 2007 made after Ministerial Decision MD-PE-2007-0206 and would update the legal backing for controls on the importation of meat and other animal products from England, Scotland and Wales.
Background
An EU decision has been enforced in England which means that meat and animal products can only be despatched from Great Britain to EU member States if it is covered by the proper certification. At the time of writing Scottish and Welsh administrations are expected to follow suit.
The restrictions are designed to help control the risk of the spread of Foot and Mouth Disease and apply to Jersey as an EU member State.
This Order would mean that the products listed by the EU cannot be imported to the Island, from England, Scotland or Wales without certificates which have been drafted for the purpose. Meat and animal products can still be imported from elsewhere – including Northern Ireland and the Republic of Ireland.
Discussion
Advice received from the Attorney General on 9 August 2007 confirms that this action is appropriate to Jersey’s status under the terms of Protocol 3 to the Treaty of Accession of the United Kingdom to the European Community.
Recommendation
The Planning and Environment Minister is recommended to approve, sign and seal the attached Diseases of Animals (Foot and Mouth Restrictions) (Jersey) Order 2007.
The Planning and Environment Department shall –
(1) inform the Assistant Greffier of the States, the States Greffe Publications Editor and the P&E’s liaison officer immediately the Order is made.
(2) deliver the signed and sealed Order to the Publications Editor.
