Jersey Aircraft Registry: Law Drafting instructions for creation

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Jersey Aircraft Registry: Law Drafting instructions for creation

Summary of Drafting Instructions

Background

In September 2013, the Minister for Economic Development, made a policy decision and consequently signed a Ministerial Decision (MD-E-2013-0089) to establish a Jersey Aircraft Registry.

An ‘Action Required’ in the ‘Decision Summary’ of the Ministerial Decision was a request for law drafting time to develop the necessary legislative framework to establish the Jersey Aircraft Registry, which has now been agreed.  However, to progress this further, it is necessary to formally outline the exact legislation that requires law drafting.

The laws to be drafted are twofold: the creation of substantial primary legislation that falls under the aegis of the Minister for Economic Development - The Aircraft Registry (Jersey) Law.

In addition, there will be a requirement for consequential amendments or replacement of existing legislation relating to air navigation, rules of air and safety and security which will be required as a result of the establishment of the Registry, together with certain updates in line with current European Union aviation standards, and as such will require substantial changes to the following legislation which all fall under the Minister for External Relations responsibilities:

  1. Repeal the Air Navigation (Jersey) Order 2008 and replace it with an Air Navigation (Jersey) Law that takes into account the updates in the UK Air Navigation Order 2009 and the Overseas Territories Air Navigation Order 2007 and current ICAO standards.

  1. Repeal and replacement of the Rules of Air (Jersey) Order 2000  - This will incorporate the new Standard European Rules which will be required by the UK at the end of 2014 and which are being proposed by the DCA.

  1. Repeal and replacement of the Air Navigation (Dangerous Goods (Jersey) Order 2009.

  1. Amendments to Civil Aviation (Jersey) Law 2008 to provide for powers of the DCA in relation to airworthiness and safety and security and registration of births and deaths occurring on Jersey registered aircrafts.

  1. Amendments to the Civil Aviation (Investigation of Air Accidents and Incidents) (Jersey) Order 2000 to provide for investigations of air accidents involving Jersey registered aircrafts

The changes to the above legislation, although required by Economic Development for the creation of the Aircraft Registry, as they are consequential, are substantial in their own right and therefore it is appropriate to have separate Ministerial Decisions from the Minister for Economic Development and Minister for External Relations, joined by a common written report.

Resource Implications:

There are no additional resource implications for the creation and amendments and replacements of the various pieces of legislation.
