A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Introduction

The purpose of this report is to ask the Minister to return funds to the value of £2,159 to the Treasury & Resources department from Education, Sport & Culture, on behalf of the Jersey Heritage Trust. This represents the costs of the Historic Child Abuse Enquiry to the Jersey Heritage Trust as outlined in a Service Level Agreement agreed in 2008, that were not needed after all objectives had been met

Background

As a result of a meeting held on 29 May 2008, a Service Level Agreement between the Chief Minister’s Department, Education, Sport & Culture, States Greffe and Jersey Heritage was created in respect of the safeguarding of documentation for a potential Committee of Inquiry into Children’s Care Homes.

The Service Level agreement states that the costs to be paid to Jersey Heritage Trust in January 2009 as £65,000 and a further £70,000 with the States of Jersey approval.

On 8 September 2008 the States approved a proposition which agreed to allocate up to £7,500,000 to the Treasury & Resources department in order to reimburse departments for actual expenditure on the Historic Child Abuse Enquiry. Of this amount, £65,000 was carried forward into 2009 as an ‘earmarked sum’ for Education, Sport & Culture in respect of a Jersey Archive contract post and £70,000 was identified as the cost of the post in 2009 in order to:

‘…fund a contract post at the Jersey Archive and improve storage to appraise and catalogue all departmental records potentially relating to the enquiry. This was agreed by the Minister for Treasury & Resources in 2008 for a period of 2 years.’

A total allocation of £135,000 was therefore paid over to the Trust and a sum of £2,159 has been reimbursed to the department.

Recommendation

It is recommended that the Minister requests the Minister for Treasury and Resources to accept a transfer of funds of £2,159 back to the Historic Child Abuse Enquiry fund held at the Treasury.
