Cycle Tracks (Jersey) Order 2000: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

CYCLE TRACKS (JERSEY) ORDER 2000

 

 

Purpose of the Report

 

To request the Minister to approve in principle an amendment to the Cycle Tracks (Jersey) Order 2000 to include recently established cycle tracks in St Helier plus a proposed track in Grouville.

 

 

Background

 

New tracks for cycles that include Gas Place alongside the Town Park and Havre des Pas Promenade are to be formalised by inclusion in the Order. Additional amendments to the Order are required to correct minor discrepancies in the descriptions of certain other cycle tracks.

 

 

Discussion

 

Plan No.1 (a) and (b) shows (by the red line) the track description to be amended between the former Fort d’Auvergne Hotel and the junction of Le Quai au Marchands with South Pier access road. This route includes Havre des Pas Promenade, part of the Reclamation access road and part of La Route du Veulle.

 

Plan No.2 shows the track to be added in Gas Place along the north edge of The Millennium Park.

 

A proposed track through the park from Gas Place to Robin Place will not be included in the Cycle Tracks Order because the park is included in the Policing of Parks Regulations.  Under these Regulations the park authority may establish a cycle track within a park by appropriate signs and markings.

 

Plan No.3 shows a proposed route on Grouville Common which will start at Rue a Don by Grouville Garage  and finish at the Pembroke Hotel. This route has yet to be constructed, therefore whilst approval in principle is sought to enable future instructions to the Law Draftsman to be made, the route does not form part of the present proposed draft amendment.

 

 

Recommendation 

 

The Minister is recommended to approve the proposed amendment to the Cycle Tracks (Jersey) Order 2000.
