Historic Buildings Register: Assessment of Halesea, Le Havre des Pas.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Purpose of the Report

The purpose of this report is for the Minister to consider whether Halesea merits inclusion in the Historic Buildings Register, having regard to the States strategic objective ‘to protect the best of the Island’s architectural heritage’ and the key objective of the Island Plan 2002 to protect and promote Jersey’s built, cultural and archaeological heritage.

Background

This report has been prepared by the Jersey Heritage Trust as part of its responsibility under a Service Level Agreement to provide reports and recommendations to the Minister for Planning and Environment on the registration of buildings and sites. It incorporates the views of the Jersey Heritage Advisory Panel (JHAP) - a group established to provide independent, expert advice on matters relating to the protection of buildings and sites of cultural interest.

In December 2005, in response to a request for pre-application advice, an Officer of the Planning and Environment Department requested that JHAP assess the architectural and historic interests of Halesea, a 1930s house at Havre des Pas.

Halesea was not included in the 1992 Historic Buildings Register and was not added to the Register by the Jersey Building Heritage Sub-Committee during its review of registered buildings in St Helier in 2002.

Discussion

JHAP carried out an external evaluation of the property during a site visit on 9 January 2006. Members agreed that the 1930s house retains its historic form and detail and is located in an area of scenic and historic importance. However, the Panel felt that the building is of limited historic and architectural interest and does not satisfy the more stringent criteria for the registration of twentieth century buildings. The Panel concluded that Halesea does not merit inclusion on the Register.

Recommendation

Halesea should not be added to the Historic Buildings Register.
