A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reasons for decision:

The Minister decided to maintain the Refusal of Planning Permission as the proposal is contrary to the policies of the Island Plan and no other material considerations outweighed the provisions of the Plan. However, the Minister was of a clear view that if the windows were replaced with timber double glazed units, the proposal may be looked upon more sympathetically by the Minister.

Comments on Case

In the applicant’s letter, it is stated that the house was originally two houses, which was converted in to one and rendered in the 1960’s and a extension added in 1995. The house has been checked over by Societe Jerriaise but they had little interest in the property. There are 3 modern developments on Mont Les Vaux and 8 BLI’s and 2 SSI’s in this area. Overall there are approximately 32 other buildings in this road, of these buildings there are 18 building that have uPVC windows. He states that this constitutes a significant majority of building in this area with uPVC windows. He also mentions that on the Policy note there is a presumption there where buildings have not retained their original windows, then contemporary materials would be allowed. The Agent also mentions about the windows needing repair and replacement and the usage of mahogany wood grain effect uPVC windows would be much cheaper than timber frames; have less maintenance problems and would have little visual impact in the street scene.

Policy HWD5 relates to building over 80 years old and says that it is encouraged to retain the original windows and replacement windows should be replicated in the same style and detail as the original. The policy also states that this will be applied flexibly and each application will be treated on its merits, having regard to the quality of neighbouring buildings and other material factors.

Having taken a site visit on 8th August 2006, I studied and took photographs of the site and neighbouring properties. The direct neighbouring properties where found to be of good quality with timber sash windows. However, properties opposite and further down the road did have uPVC double glazed windows. Therefore, the use of wood effect uPVC windows in this property would detract from the intrinsic architectural quality and historic value and would have a detrimental impact to historic neighbouring properties and to the street scene as a whole
