Removal of 6 Havre des Pas, St. Helier, as Building of Local Interest.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment resolved to remove 6 Havre des Pas (Wack’s Bar), St Helier from the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a proposed Site of Special Interest.

Reason(s) for Decision:

6 Havre des Pas (Wack’s Bar), St Helier, is not of significant or sufficient historic or architectural interest relative to the published criteria for selection, to warrant its retention on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey.

Purpose of the Report

To seek to confirm the Assistant Minister’s intention to remove 6 Havre des Pas (Wack’s Bar), St Helier from the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a proposed Site of Special Interest (pSSI). 

Background and discussion

6 Havre des Pas (Wack’s Bar), St Helier is presently on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a proposed Site of Special Interest (pSSI). 

The Assistant Minister previously considered a report on the matter prepared by Jersey Heritage dated 10 November 2008 and determined that 6 Havre des Pas (Wack’s Bar), St Helier was not of sufficient interest to warrant its retention on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a proposed Site of Special Interest (pSSI). A notice of the Assistant Minister’s intent, as set out above, was served on the owner of the property on 31 December 2008 in order to provide an opportunity for representations to be made. 

No representations have been received. 

Legal and resource implications

The inclusion of buildings and places in the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey is consistent with the purposes of the Planning and Building (Jersey) Law 2002. 

Discussion and recommendation

On the basis of the recommendation of Jersey Heritage to remove 6 Havre des Pas (Wack’s Bar), St Helier from the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance as a proposed Site of Special Interest (pSSI).and in the absence of any representations, the Minister is further recommended to confirm the removal of this building from the Register.
