Road Traffic (Rue des Pres Trading Estate) (Jersey) Order 2017 Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

GROWTH, HOUSING AND ENVIRONMENT

 

AMENDMENT TO ROAD TRAFFIC (RUE DES PRÉS TRADING ESTATE) (JERSEY)

 

ORDER 2017

 

 

Purpose of the Report

 

To introduce the ability for drivers to use a Parking App to pay for parking on road areas at Rue des Prés Trading Estate and to update the Schedule of designated permit only zones.

 

 

Background

 

In 2017 the Minister approved the introduction of a Parking App which can be used in all Department operated chargeable car parks and for on-street locations in St Helier. This was not applied to roads at Rue des Prés Trading Estate at the time as the long-term policing responsibility had not been agreed. This is now under the administration of the Parking Control Section of Growth, Housing and Environment so checking payments via the parking app can be carried out easily.

 

There have also been a number of changes to permit zones within the Trading Estate and the appropriate Schedules can be updated at this time.

 

 

Discussion

 

The option of using the Parking App to pay for parking within St Helier has proved to be popular with drivers, and extending this to the paycard areas on roads in Rue des Prés Trading Estate will give the option of either using paycards or the Parking App.

 

Demand for additional permit only spaces within the Trading Estate has resulted in some changes to the original areas created. The appropriate Schedules in the Road Traffic (Rue des Prés Trading Estate) (Jersey) Order 2017 need to be updated to reflect these changes.

 

 

Conclusion

 

The amendment will enable drivers to have the choice of using the Parking App as well as paycards when parking in the paycard areas on the roads within Rue des Prés Trading Estate and will update the designated permit only zones there.

 

 

Recommendations

 

The Minister is recommended to instruct Officers to issue Legislative Drafting instructions to amend the Road Traffic (Rue des Prés Trading Estate) (Jersey) Order 2017.

To introduce an alternative method of paying for parking at Rue des Prés Trading Estate and to update the Schedules of designated permit holder only parking zones.
