Road Traffic (St. Lawrence) (Jersey) Order Amendments.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

To prohibit vehicles exceeding 6’6” from using La Rue de Haut, and Mont Cambrai, prohibit waiting on a section of Les Charrieres Malorey for a period not exceeding 12 hours in any 24 hours, to make the unnamed road that runs between Sandybrook Lane and La Vallée de St. Pierre subject to a roads closed to through traffic restriction, and to prohibit waiting on a section of La Rue de la Blanche Pierre.

ROAD TRAFFIC (SAINT LAWRENCE) ( JERSEY ) ORDER 1990

Purpose of the Report

To amend the Road Traffic (St Lawrence) (Jersey) Order 1990.

Background

The Connétable of St Lawrence has written to the Department requesting the Minister for Transport and Technical Services to make an Order to prohibit vehicles exceeding 6 feet 6 inches in width from using La Rue de Haut and Le Mont Cambrai, to restrict waiting on a section of Les Charrieres de Malorey for a period not exceeding 12 hours in any continuous period of 24 hours, to make the unnamed road that runs between Sandybrook Lane and La Vallée de St Pierre subject to a “roads closed to through traffic”, restriction, and to prohibit waiting on a section of La Rue de la Blanche Pierre.

Discussion

The request with regard to La Rue de Haut is considered necessary to prevent this narrow, heavily residential road from being used by large vehicles as a short cut from La Vallée de St Pierre. This restriction would necessitate the inclusion of Le Mont Cambrai, as this road terminates into La Rue de Haut.

The request with regard to Les Charrieres Mallory is considered necessary as the Parish Honorary Police have frequently observed vehicles parked there for excessive periods of time. This is a particular problem at certain times, as this parking area is in close proximity to the “War Tunnels”.

The request with regard to the unnamed road that runs from Sandybrook Lane to La Vallée de St Pierre, is due to the danger of vehicles exiting from this very steep, and narrow residential road onto La Vallée de St Pierre, due to the lack of visibility.

The request with regard to La Rue de la Blanche Pierre is considered necessary to prevent vehicles from parking on the bends on both sides of the bottom of La Rue de la Blanche Pierre, at its junction of La Vallée de St Pierre and La Ruette Corbel.

Recommendation

The Minister is recommended to approve the requests.

Reasons(s) for Decision

1. To make La Rue de Haut subject to a 6 feet 6 inches width restriction.

2. To make a section of Les Charrieres Malorey subject to a 12 hours in any continuous period of 24 hours waiting restriction.

3. To make the unnamed road that runs between Sandybrook Lane and La Vallée de St Pierre subject to a “Roads closed to through traffic” restriction.

4. To prohibit waiting on a section of La Rue de la Blanche Pierre.

Action Required

The Minister to request Officers to instruct the Law Draftsman to prepare an Amendment to the Order for subsequent submission to the Minister.
