Field P790, St. Peter: Highway Agreement

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister signed the Highway Agreement in relation to access and highway improvements at Field P790, L'Avenue de la Reine Elizabeth II, St Peter.

 

Reason(s) for Decision: To provide a pedestrian and cyclist refuge island on L’Avenue de la Reine Elizabeth II, St Peter to improve pedestrian and cyclist access to the new sports training facility on Field P790.

 

Resource Implications: The highway design and construction works are being funded entirely by the Developer. The cost of developing the Highways Agreement, checking and approving the drawings and specification, and monitoring the works on site is to be covered from IHE revenue budgets, estimated at £7,000.

INFRASTRUCTURE, HOUSING AND ENVIRONMENT

 

FIELD P790, ST PETER – Highway Agreement

 

 

Purpose of the Report

 

To request the Minister to approve and sign the Highway Agreement in relation to access and highway improvements at Field P790, L'Avenue de la Reine Elizabeth II, St Peter

 

 

Background

 

Team Athlete Holdings (Jersey) Ltd has planning permission to build a sports training facility on Field P790, L’Avenue de la Reine Elizabeth II, St Peter. As well as a new vehicular access to the site, the developer is required to improve pedestrian and cyclist access, by widening L’Avenue de la Reine Elizabeth II, and introducing a pedestrian refuge island.  The Highway Agreement in relation to Access and Highway Improvements at Field P790, sets out the means by which the work shall be carried out by the developer, and in a way that the works are carried out to appropriate standard and in a timely manner.

 

 

Proposal

 

The proposed scheme is to install a pedestrian refuge island adjacent to Field P790 St Peter and requires the following:

 

  • Road widening
  • Footpath widening
  • Pedestrian Refuge Island with associated dropped kerbs and tactile paving
  • New widened and improved access
  • Consequential amendments to utilities to accommodate the wider road and new access
  • A new bus shelter
  • Roadside landscaping on the developers land and as part of their Planning Permit

 

Team Athlete Holdings are required to carry out the Highway and Access Works to meet with, and discharge the conditions of, their Approved Planning Permit.

 

The length of L’Avenue de la Reine Elizabeth II abutting Field P790 will be handed over to the developer to carry out the works to change the road, and then handed back to The Highway Authority on completion. The Highway Agreement sets out the duties and responsibilities of the parties to ensure that the works are carried out to appropriate standards, to an acceptable programme and in such a way as to limit the impact of the works on the Public.

 

The detailed programme, specification and drawings will be approved by the Director of Operations and Transport, by letter of technical approval, before any work on the Highway can commence.

 

 

Recommendation

 

The Minister is recommended to sign the Highway Agreement in relation to access and highway improvements at Field P790, L'Avenue de la Reine Elizabeth II, St Peter.
