Jersey International Air Display 2010 - 9 September 2010 - preparation of Order - Entertainments on Public Roads (Jersey) Law 1985

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the preparation of an Order under Article 2 of the Entertainments on Public Roads (Jersey) Law 1985 to enable The Jersey International Air Display 2010.

Reason(s) for Decision: The Minister accepted that the proposed road closures and associated traffic management appeared both reasonable and justified (subject to the completion of statutory draft Order consultation with other relevant authorities).

Resource Implications: TTS Officer and Law Draftsman’s Time. TTS’ Road Signs and Markings Section to provide assistance to the Honorary Police in putting out traffic signs prior to the start of the event and collecting / storing traffic signs after the event.

Action Required: To forward a copy of the Ministerial Decision along with an Instructing Memorandum and the Promoter’s Application to the Law Draftsman.

TRANSPORT AND TECHNICAL SERVICES  

THE JERSEY INTERNATIONAL AIR DISPLAY 2010 APPLICATION

FOR ROAD CLOSURES PREPARATORY TO VIEWING THE EVENT  
 

Purpose of the Report  

To obtain a Ministerial Decision to approve road closures and traffic restrictions for the purpose of holding the Jersey International Air Display from St Aubin’s Bay Promenade on Thursday 09 September 2010.   

In addition, to enable an instruction to be sent to the Law Draftsman requesting preparation of an Order under Article 2 of the Entertainments on Public Roads (Jersey) Law 1985.  
 

Background  

The Jersey International Air Display (the Promoter) has submitted details of its proposed road closures and traffic restrictions allowing the public to view the air display from St Aubin’s Bay Promenade, along with a number of other provisions preparatory to holding / viewing the event, such as crowd safety and spectator parking. The event is enabled by Order of the Minister for Transport and Technical Services under Article 2 of the Entertainments on Public Roads (Jersey) Law 1985.  
 

Discussion  

Closure of Victoria Avenue for Viewing the Display: Traffic management will be as per 2009, with Victoria Avenue and its approach roads fully closed to through traffic (i.e. Bel Royal to West Park) between 12pm and 5.30pm on Thursday 09 September. 

Restrictions to vehicle movement on Victoria Avenue during the display, introduced in 2006 to address safety concerns raised by the States and Honorary Police, will again be implemented (see attached Victoria Avenue Traffic Management Plan).  

In addition, the following traffic measures will be introduced during the closure of Victoria Avenue:  

·     Two-way traffic flow will be permitted through the bus lay-by at Bel Royal to enable east / west bound traffic to divert between La Route de St Aubin and La Route de la Haule.

 

·     The section of St Peter’s Valley from the junction of Rue du Haut to Bel Royal will be closed to all southbound traffic except for buses and HGV's. Traffic will be diverted along Rue du Haut to its junction with La Route de St Aubin, thus relieving the Bel Royal junction.

 
 

·     La Rue du Haut (St Lawrence) is to be closed to traffic travelling west from its junction with Le Mont Cambrai.

 

·     Rue de la Ville Emphirie will be made one way westbound only.

 

People’s Park Static Display: The People’s Park car park will be closed from 6pm on Wednesday 08 September until 10am on Friday 10 September, to enable the stationing of aircraft on the park (including an allowance for any delays to the departure). 

Beach Closure: St Aubin’s beach will be closed to the public between the western wall of Elizabeth Marina and La Haule slipway from 12.30pm until 5pm on both Wednesday 08 September during practice flights and again from 12.30pm until 5.30pm on Thursday 09 September for the display. 
 

Recommendation 

The Minister is recommended to approve in principal the Jersey International Air Display 2010 and the preparation of an Order under Article 2 of the Entertainments on Public Roads (Jersey) Law 1985. 
 

Reason(s) for Decision 

The proposed road closures and associated traffic management are reasonable and justified in the light of the positive benefits to the Island.
