Jersey Police Authority: Re-Appointment of Member

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DECISION AND REASON FOR THE DECISION:

 

In accordance with Article 5 (3) of the States of Jersey Police Force Law 2012, the Minister, with the agreement of the Chairman of the Police Authority, re-appointed Mr Andrew Cornish as a member of the Authority for an additional four year term.

 

Mr Cornish was first appointed as a member in February 2014.

 

Following this re-appointment, the Authority will consist of a Chairman, four members who are not elected members of the States and two members who are elected members of the States. This adheres to the requirements of Article 5 (1) of the 2012 Law.

 

RESOURCE IMPLICATIONS:

 

Membership of the Authority is undertaken on an Honorary basis.

Background

The States of Jersey Police Force Law 2012 provides that the Jersey Police Authority shall consist of not less than 5 and not more than 7 members, comprising a Chairman, who is not an elected member of the States Assembly, appointed by the Minister; up to 4 members, not being elected members of the States Assembly, who are appointed by the Minister and the Chairman; and up to 2 members who are elected members of the States Assembly, appointed by the States Assembly by secret ballot.

 

MD-HA-2017-0079 confirmed the appointment of Dr Jason Lane as Chairman of the Authority for a period of four years, effective from 10th February 2018.

 

MD-HA-2018-0016 appointed three members of the Authority who were not elected members of the States, effective from 10th February 2018.

 

Deputy Scott Wickenden and Deputy Judith Martin remain as the elected States Members on the Authority.

 

Re-Appointment

Mr Andrew Cornish was first appointed to the Authority from 10th February 2014 (see MD-HA-2014-0008). In accordance with Article 5 (1) (b) and Article 3 of the States of Jersey Police Force Law 2012, the Minister (with the agreement of the Chairman of the Police Authority) has agreed to re-appoint Mr Cornish as a member of the Authority for an additional four year term. Mr Cornish’s term of office is effective from 10th February 2018.

 

Following this re-appointment (and MD-HA-2018-0016), the Authority will consist of a Chairman, four members who are not elected members of the States and two members who are elected members of the States, and therefore be compliant with the 2012 Law.
