Budget Transfer to Education Department: Jerriais Teaching in Schools

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Various one off budget transfers for the funding of teaching Jèrriais in Jersey primary schools, following the approval by the States Assembly of the 2016 MTFP 7th Amendment. This Ministerial Decision supersedes MD-E-2016-0027.

Decision(s):

The Assistant Minister approved the various one off budget transfers, as laid out in the attached written report, following the approval by the States Assembly of the 2016 MTFP 7th Amendment. This Ministerial Decision supersedes MD-E-2016-0027.

Reason(s) for Decision:

Following the approval by the States Assembly of the 2016 MTFP 7th Amendment, the States Assembly decided to review the funding approach for the ongoing provision of Jèrriais teaching in Jersey primary schools.

 

Following the debate, a different funding approach was adopted for the future teaching of Jèrriais involving the recruitment of a second teacher to be funded by the Chief Minister’s Department. As a consequence this Ministerial Decision is required to supersede MD-E-2016-0027.

 

Article 18(1)(c) of the Public Finances (Jersey) 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure. Delegation 1.2 delegates authority for non-contentious transfers between heads of expenditure of up to £1,000,000 to the Treasurer of the States.

Resource Implications:

The EDTSC Jèrriais budget to decrease by the amounts laid out in the attached written report and the Department for Education budget to increase by an identical amount.

 

 

Action required:

The Assistant Minister for Economic Development, Tourism, Sport and Culture to seek approval from the Treasurer of the States for the transfers.
