Road Traffic (Speed Limits) (Amendment No. 4) (Jersey) Order 2009.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):   The Minister made the Road Traffic (Speed Limits) (Amendment No 4) (Jersey) (Order) 2009.

Reason(s) for Decision: To allow adjustments to the speed limits outside Trinity School and St Lawrence School, to enable the effective operation of part time 20mph speed limits at these locations.

Resource Implications:  The minor changes to signing at each of the locations can be carried out within the budget identified for part time speed limit installations, and by TTSd staff.

Action required:  To notify the Greffier of the States and the Law Draftsman that the Order has been made and forward the signed and sealed Order to the Publications Editor, States Greffe, for notification to the States.  The Department to carry out the required revisions to the road signing at the two locations affected.

ROAD TRAFFIC (SPEED LIMITS) (AMENDMENT NO 4) (JERSEY) ORDER 2009  
 

Purpose of the Report  

To make the Road Traffic (Speed Limits) (Amendment No 4) (Jersey) Order 2009 
 

Background  

The Department has been working to install part time 20mph speed limits outside several of the Island’s primary schools.  The lighting equipment and signage to implement part time 20mph speed limits has now been installed at Trinity School and St Lawrence School. 

In accordance with MD-T-2008-0097 the Department requested the Law Draftsman to prepare an amendment to the Road Traffic (Speed Limits) (Jersey) Order 2003, an amendment required as part of the scheme to install part time limits at the two locations detailed above. 
 

Discussion  

Trinity School  

The equipment to implement a part time 20mph speed limit outside Trinity School has now been installed.  The flashing lights which signify that the speed limit is in operation operate on a time clock for the periods when children are going to or coming from school in the morning and afternoon.  Teachers are also able to operate the lights when children are required to cross the road to the sports field. Before work commenced, it was agreed with the Parish of Trinity that the current 30mph speed limit would be removed.   

The Minister should be aware that some of the residents who live near to Trinity School have asked that the 30mph zone be left in place.  The 30mph speed limit was placed here specifically for the school, but has not proved to be effective at slowing vehicles down. The carefully targeted part time 20mph is more appropriate and expected to be more effective.  As this location does not conform to the States of Jersey speed limits policy for the location of a 30mph zone, and to maintain the effectiveness of speed limits that do, this 30mph speed limit should now be removed. 
 

St Lawrence School  

Equipment to implement the St Lawrence School part time 20mph speed limit has also been installed. The northern end of the current 30mph zone for the St Lawrence Village area on La Grande Route de St Laurent lies partly within the part time 20mph speed limit zone.  This is considered to be confusing.  Following consultation with the Parish of St Lawrence it was considered best to move the northern boundary of the 30mph zone north so that the Three Oaks Garage and nearby businesses and houses on both sides of the road came within the 30mph limit zone. 
 

Conclusion  

Now that the necessary signing and lighting to implement the part time speed limits outside Trinity School and St Lawrence School has been installed, it is appropriate to make the Road Traffic (Speed Limits) (Amendment No 4) (Jersey) Order 2003 
 

Recommendation  

The Minister is recommended to make the Order amendment.
