Report to the Economic Development Minister
Request for "J" Category Licence approval - Legal & Intelligence Manager
1. Purpose of the Report
1.1 The Minister is asked to support a request and recommend approval of a five year "J" category licence for the new post of Legal & Intelligence Manager
2. Background and Discussion
2.1 The Department currently has a vacancy for the post of Legal & Intelligence Manager which is a permanently funded post. The job description has been evaluated at Grade 12.
2.2 This is a new highly specialised post that will be responsible for developing and maintaining an intelligence database to ensure compliance with international standards and best practice, together with a fit-for-purpose legal framework that will both enhance Jersey’s world-wide reputation as a safe and well-regulated place to do business and also encourage inward investment and new business start-ups.
The role includes:
· development of modern gambling legislation and regulation through an independent Gambling Commission
· development and implementation of an effective anti-money laundering regime for gambling business in Jersey that conforms to the standards required by the Financial Action Task Force, to ensure the Island’s financial integrity and international reputation.
2.3 The person specification for the post requires a high level of professional qualifications, together with broad specialist experience. The Director of Regulatory Services anticipates that the likelihood of attracting a candidate with the appropriate skills and experience to fulfil this crucial role from within Jersey is remote.
2.4 The post will be advertised in the JEP on May 4th with a closing date of May 18th. In view of the need to deliver key operational objectives before the end of 2006, and the anticipated lack of suitably qualified local applicants for this post, it is considered expedient to obtain consent for the award of a “J” category licence in advance of the local closing date.
2.5 The “J” category licence would only be used in the event that recruitment from within the island was unsuccessful.
3. Recommendation
3.1 The Minister for Economic Development endorses the proposal to secure the necessary approvals to enable the appointment of a suitably qualified, experienced and skilled person from outside the Island under the auspices of the Housing (General Provisions)(Jersey) Regulations 1979, Regulation 1(1((j) for the post of Legal & Intelligence Manager on the basis of a five year “J” category housing licence.
