Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Summary

This property used to belong to Mr Leslie Till a well known Butcher in the 60’s to 80’s. Up to 1970 he used to rear up to 300 pigs for his business. In the late 60’s and early 70’s Horse Riding Stables were built and fields nearby were used for horses.

There are two areas of land which are currently being used by Jayen (Jersey) Limited, a Civil Engineering Company, to store machinery, materials and equipment.

One area of land adjoins Field 668A and I am informed had been used as a stone mason’s yard for a number of years. We have no record of this use and it is doubted if it existed in 1970 as the Committee visited the site but made no mention of it, but it did mention other unauthorised developments. The stone mason’s area does appear on the 2003 aerial photographs.

The other area of land is situated alongside an old greenhouse that had been converted to stables.

Aerial photographs show that it had been used for the parking of vehicles and storage of assorted items thought to be associated with the use of the property as riding stables.

A spokesman for Jayen said that he did not think a change of use was required as he understood the land was classified as commercial. He has been informed that it may very well be commercial land but its present use does constitute a change of use.

Recommendation

That notice is served upon owner and occupier to cease using the land in question for the storage of engineering machinery, materials and equipment. In accordance with Article 40 of the Planning and Building (Jersey) Law 2002, failure to comply would result in papers being referred to the Law Officer’s Department in accordance with Article 44 of the said Law.
