A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Conclusion

The proposal is to install an additional 2 no. dishes for Jersey Airtel. Jersey Airtel have equipment already installed at the site, however once erected it was discovered that two additional transmission links are required. 

The application is a mast sharing opportunity at one of the existing 5 major communication sites on the Island.

Site Description

The site is the largest lattice tower on the Island at 140 metres tall. It is owned and managed by Arqiva, an international communications company.

 

 

Relevant Planning History

S/2006/0930 Approval granted in June 2006 for 6no. antennae, 9no. dishes and 3no. equipment cabinets for Cable and Wireless. 

RP/2006/1408 Approval granted in August 2006 for revised plans to the above application S/2006/0930 for an additional dish for Cable and Wireless. 

S/2006/1961 Approval granted in January 2007 for 2no. antennae, 6no. dishes and 5no. equipment cabinets.  

S/2006/2446 Approval granted in January 2007 for 2no. antennae and 1no. equipment cabinet for Jersey Telecom.

Consultations

H&SS in their letter dated 4 October 2007 confirm that the application is not for a mobile base station so the lack of an emission level certificate is not an issue. The Declaration of ICNIRP is sufficient to satisfy the H&SS Department.

Planning Issues

Policy Considerations

In accordance with NR12, telecommunications development will normally be permitted where:

(i) siting and design will not unreasonably affect the character and amenity of the area;

(ii) all practicable possibilities of sharing facilities have been fully explored and found to be unfeasible or unacceptable by the Minister;

(iii) there would be no unacceptable impact on residential amenity;

(iv) the proposal is in accordance with other principles and policies of the Plan. 

Siting and Design

The application is to install equipment on the existing tower at Fremont. This mast has been in existence since the 1960’s and therefore is an established telecommunications site. The siting of the antennae, being on an existing lattice tower, will not materially impact on the appearance of the tower and thus the antennae will not unreasonably affect the character of the area. 

Site Sharing

The necessity of this proposal is to provide additional transmission links to other sites.  

This application is for mast sharing at one of the existing 5 major communication sites on the area.  

Residential Amenity

The site is remotely located from residential properties. There will be limited impact to residential amenity from this application, as the main impact to the area is from the tower itself, which is an established communications site on the Island.

The proposal is in accordance with the other policies of the Island Plan.

Conditions/

Reasons

1. The development hereby permitted is temporary and shall cease on or before 12 months from the date of this permit and the land restored to its former condition unless the post commissioning test is completed and the relevant measurements are in accordance with the ICNIRP certificate submitted, to the satisfaction of the Minister for Planning and Environment. 

2. The permission hereby granted is for a temporary period of 12 months in the first instance. In the event that the Minister for Health and Social Services, during that 12 month period, should change his policy on the safety of telecommunication installations to the effect that they constitute a danger to the public nearby, the Minister for Planning and Environment will review the permission and may require the installation to be removed within a period of 3 months of the Minister for Health and Social Service’s change of policy. Should the Minister for Health and Social Service’s policy not change within 12 months, this permission will have permanent effect.  

3. The development hereby permitted is temporary and shall cease on or before 12 months from the date of this permit and the land restored to its former condition unless a programme of ongoing monitoring of the installation is submitted to and approved in writing by the Minister for Planning and Environment.  The scheme shall include monitoring in accordance with the ICNIRP certificate provided, appropriate independent testing at 12 monthly intervals for the duration of the operation of the installation, and shall be funded by the operator.
