The Road Racing (Festival of Speed) (Jersey) Order 2010 – 27 to 29 August 2010

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the ‘Road Racing (Festival of Speed) (Jersey) Order 2010’ as prepared on behalf of Transport and Technical Services, as the administering authority of the Motor Vehicle Races (Jersey) Law 1946.

Reason(s) for Decision: Further to MD-T-2010-0059, enabling preparation of the Order, the Minister accepted that the proposed road closures and associated traffic management were both reasonable and justified.

Action required: To notify the Greffier of the States and the Law Draftsman that the Order has been made and forward the signed and sealed Order to the Publications Editor, States Greffe, for notification to the States.

TRANSPORT AND TECHNICAL SERVICES  

THE CLASSIC & VINTAGE MOTOR RACING CLUB’S APPLICATION TO HOLD

THE  ‘FESTIVAL OF SPEED’ 2010  
 

Purpose of the Report  

To accompany the signature copy of the ‘Road Racing (Festival of Speed) (Jersey) Order 2010’ enabling road closures and traffic restrictions for the purpose of holding the ‘Jersey Festival of Speed’ racing event between Friday 27th and Sunday 29th August 2010. 

Background  

The Classic & Vintage Motor Racing Club (the Promoter) has submitted details of its proposed road closures and traffic management requirements for the 2010 events. The events are enabled by Order of the Transport and Technical Services Minister under Article 2 of the ‘Motor Vehicle Races (Jersey) Law 1946’.  

The Promoter has consulted with the Connétables of St Mary, St Ouen and St Brelade, who have endorsed the event, as well as undertaking a public relations exercise with residents and businesses directly affected by the road closures. They have also supplied proof of Public Liability Insurance. 

Discussion  

The Order will enable the event promoter to hold the following events: 

o     Sprint - Five Mile Road – Friday 27th August 2010 (12pm to 5pm): La Grande Route des Mielles from Led Brayes Car Park to the gravel car park at La Pulente.

 

o     Hill Climb - Greve de Lecq – Saturday 28th & Sunday 29th August 2010 (8.30am to 5pm): Le Mont de Ste. Marie, but including a number of parish by-roads at the top of the hill to allow turning.

 

The course details are identical to those which were approved last year. Access to Greve de Lecq bay via Mont de la Greve de Lecq (B65) will be maintained during the event; no scheduled bus services will be affected. Other details are as per the 2010 Order.  

Recommendation 

The Minister is recommended to sign the ‘Road Racing (Festival of Speed) (Jersey) Order 2010’ as prepared. 

Reason(s) for Decision 

Further to MD-T-2010-0059, enabling preparation of the Order and following consultations, the proposed road closures and associated traffic management are reasonable and justified.
