Temporary Amendment to the Road Traffic (Trinity) (Jersey) Order 1988.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

LE MONT DE ROZEL TEMPORARY AMENDMENT TO PROHIBIT WAITING ON TWO SECTIONS OF LE MONT DE ROZEL  
 

Purpose of the Report  

To make a temporary amendment to the Road Traffic (Trinity) (Jersey) Order 1988 

Background

 

The Connétable of Trinity has requested a temporary amendment to the Road Traffic (Trinity) (Jersey) Order 1988 to prohibit waiting on two sections of Le Mont de Rozel. The temporary order is to be made under Article 68 of the Road Traffic (Jersey) Law 1956 for a period not exceeding 12 months. 

Article 68 enables changes to Traffic Orders to be made, for a period of up to 12 months, without waiting for the relatively lengthy process of amending Orders to be completed.  

Discussion

 

The request for the temporary prohibition of waiting has been made as a result of a section of the roadside retaining wall subsiding. The Connétable is concerned for the safety of motorists using and parking on this section of the road until the repairs to the road and the retaining wall have been carried out.

 

Recommendation 

The Minister is recommended to approve the attached notice, as required by Article 68 of the Road Traffic (Jersey) Law 1956 to come into effect within seven days after its insertion into the Jersey Gazette. 
 

Reason (s) for Decision 

To prohibit waiting on two sections of Le Mont de Rozel.

The Minister to instruct his officers to arrange for a notice to be inserted in the Jersey Gazette, as required by Article 68 of the Road Traffic (Jersey) Law 1956, on two occasions during the seven days immediately preceding the date on which it is to have effect.
