Transfer of Capital Projects to Property Holdings

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

· The Minister agreed to transfer the management, administration, budgets and associated expenditure of the following capital projects to the Property Holdings Department:

Reason(s) for decision:

· In June 2005 the States agreed to the creation of a new property holdings department to be responsible for the administration and maintenance of all States property with the exception of social rented housing and property owned by the trading departments.

· The property services and public buildings functions of the Transport and Technical Services Department, the maintenance function of the Department for Education, Sport and Culture and the non social rented land and property from the Housing Department have already been transferred to the Property Holdings Department.

· Following discussions between officers it is now proposed that the management and budgets for property related capital projects be transferred from the Home Affairs Department the Property Holdings Department with effect from 1 February 2007.

Financial Implications

The transfer has no additional financial or manpower implications for the States.

Action required:

· Notify Minister for Treasury and Resources.

· Finance Director to provide Treasury and Resources Department with the appropriate accounting codes for transfer.

Introduction

The purpose of this report is to seek the Minister’s approval to transfer four current capital projects plus all future property related capital projects from the Home Affairs Department to the Property Holdings Department.

Background

In June 2005 the States agreed to the creation of a new property holdings department to be responsible for the administration and maintenance of all States property with the exception of social rented housing and property owned by the trading departments.

The property services and public buildings functions of the Transport and Technical Services Department, the maintenance function of the Department for Education, Sport and Culture and the non social rented land and property from the Housing Department have already been transferred to the Property Holdings Department.

Following discussions between officers it is now proposed that the management, administration, budgets and expenditure to date for the following capital projects be transferred from the Home Affairs Departments to the Property Holdings Department with effect from 1 February 2007.

It is also proposed that all future property related projects for the Home Affairs Department should be administered and managed by the Property Holdings Department, subject to the close involvement of the Heads of Service as members of any project groups.

Recommendation

It is recommended that the Minister agrees:

(i) the budget transfer of £8,712,700 and associated expenditure to date of £533,318.18 to the Property Holdings Department;

(ii) in principle, that all future property related projects for the Home Affairs Department should be administered and managed by the Property Holdings Department, subject to the close involvement of the Heads of Service as members of any project groups;

(iii) to notify the Minister for Treasury and Resources in accordance with Financial Direction 3.6 – Variations to Heads of Expenditure.
