A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Request for reconsideration of refusal of planning permission

Decision(s)

The Minister elected to maintain the previous decision to refuse the application. He further invited the applicant to consider submitting a revised application for permission to demolish the existing metal shed at the site and to construct a significantly more modest replacement building.

Reason(s) for decision:

The site is a very prominent and sensitive one and the proposal for a non-agriculturally related building of the size proposed is contrary to Policy C5, G2 and G3 of the Island Plan 2002.

Action required:

Notify Agent that the Minister would be prepared to consider the removal of the corrugate building and their replacement with a new building, with an extension.

1. The site lies in a prominent location the Green Zone wherein there is a presumption against development for whatever purpose including the extension of commercial properties. The erection of a building of the size and scale proposed would visually harmful and therefore fails to satisfy the criteria of Policy C5, G2 and G3 of the Island Plan 2002 which seek to protect the countryside from harmful development.

Comments on Case

The Department has been in discussion with the applicant over a number of years regarding the provision of a storage building on site for his marquee business. Concern has always been expressed about the size of any new building as Policy C5 does not allow for large, non-agricultural buildings in the countryside and there are many redundant farm sheds available. Indeed the applicant was renting accommodation at Les Peupliers Farm, St Ouen but recently gave up the renewal of the lease when the rent became too expensive for him to continue using the building. The applicant currently also rents a shed at Greenlands, St Ouen. There is also a temporary consent on this site for a marquee used as a storage area. There have been no letters of representation.

The applicant has run a very successful business for over 27 years and has an approved base at this site. The land is available and he therefore considers that the removal of an area of unsightly corrugated iron buildings and their replacement with a significantly larger building is the way forward. The applicant also considers that it is more environmentally responsible to store equipment on the base site than a mile away in rented sheds.

The Department was not only concerned about the size but also the design of the proposed building, although this could be overcome if the principle of the shed was agreed.

The site does have the benefit of a good amount of mature screening but it is still considered that there would be unacceptable visual impact in the landscape and that this is contrary to Policy C5.
