A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

LC25, LC26, LC27, LC29 & LC30 La Collette – New Leases

Decision(s):

  1. The Assistant Minister rescinds the following MD’s – MD-E-2009-0079, MD-E-2009-0076, MD-E-2009-0075, MD-E-2009-0074, MD-E-2009-0073 and MD-E-2009-80
  2. The Minister approved the termination of: - All and any existing agreements that may exist in relation to Jersey Harbours lettings LF09B, LF09C, LF09D & LF09E at La Folie St Helier
  3. The Minister approved the letting of:
    1. LC25, La Collette (Unit 1)  – Lease to Bill Keating Marine Engineering Ltd for a term of 9 years on the terms and conditions set out in the attached report.
    2. LC26, La Collette (Unit 2) – Lease to Dave Warn Marine for a term of 9 years on the terms and conditions set out in the attached report.
    3. LC27, La Collette (Unit 3)  - Lease to Bill Hibbs Marine Ltd for a term of 9 years on the terms and conditions set out in the attached report.
    4. LC29, La Collette (Unit 5)  - Lease to Fox Marine Services Ltd for a term of 15 years on the terms and conditions set out in the attached report.
    5. LC30, La Collette (Unit 6) – Lease to Precision Plastics (Jersey) Limited for a term of 15 years on the terms and conditions set out in the attached report.

Reason(s) for Decision:

Under Standing Order 168 (2) (a) & (b) the Minister is required to seek the approval of the Minister for Treasury and Resources for recommendations to dispose, acquire, let or rent land on behalf of the Public of Jersey. 

Under Standing Order 168(3) the Minister for Treasury and Resources must, at least 15 working days before any binding arrangement is entered into, present to the States a document setting out the recommendation which he or she has accepted. 

To allow for the area of the La Folie Estate to be redeveloped

Resource Implications:

There are no financial or manpower implications in respect of this decision other than those detailed in the report.

Action required:

In accordance with Standing Order 168 (2) (b) this decision must be presented to the Minister for Treasury and Resources.

Once the approval of the Minister for Treasury and Resources has been gained, Jersey Harbours to pass the necessary contract, and to copy this decision to Property Holdings.
