Fish Farming Licence: Jersey Oyster Company Ltd

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved a fish farming licence with an extension in holding area and addition of European Flat Oyster (Ostrea edulis) as an authorised species

Reason(s) for Decision: The Minister is responsible for the issue of fish farming licences under the Sea Fisheries (Fisheries)(Jersey) Regulations 2010.

Following the authorisation by the Minister to allow publication in the Jersey Gazette (MD–E-2012-35), the draft licence was advertised on 04 April 2012. The period during which any objections to the granting of this licence could be made expired on 04 May 2012. No objections were received.

Resource Implications: There are no financial or manpower implications at this stage

Action required: Fisheries Officers will issue the licence to Jersey Oyster Company Ltd subject to the conditions governing aquaculture

AUTHORISATION TO ISSUE A FISH FARMING LICENCE

 

Purpose of the Report

 

The Minister is responsible for the issue of fish farming licences for the establishment of a fishery under the Sea Fisheries (Fisheries) (Jersey) Regulations 2010. An application to modify an existing act of authorisation has been received by the Department. This report details the application and makes a recommendation to issue the modified fish farming licence

 

Background

 

The applicant, Jersey Oyster Company Ltd, wishes to extend their holding bed concession area and have the European Flat Oyster (Ostrea edulis) added to the list of species which they are authorised to establish a fishery for. Any change to an existing act of authorisation is treated as a new application, and should receive a similar level of public consultation. The Sea Fisheries (Fisheries) (Jersey) Regulations 2010 specify that an application should be published in the Jersey Evening Post Gazette, to allow comments to be received from the general public. If comments are received, they are then put before an independent adviser. The Minister then reviews the application in light of public opinion, which is then vetted by an independent adviser

 

Details

 

Jersey Oyster Co. Ltd.’s application was considered by the Fisheries and Marine Resources Panel on the 25th January 2012. The Panel agreed to recommend to the Minister that the application be published in the Gazette in draft to allow for comments from the General Public. The Receiver General has also been consulted

Recommendation
