A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s) –

This application was discussed at a public meeting 28 September 2007, but the item was deferred by the Minister for further information.  Amended plans were subsequently submitted and on the 20 November 2007 the Minister decided to grant Planning Permission for the scheme.

 

 

 

Reason(s) for decision:  The conversion of the roofspace as demonstrated by the amended plans, with high level rooflights will not so detrimentally affect the nearby dwellings as to justify refusing the application

Conclusion

This application seeks to make use of the roof space area of the two dwellings as previously approved. By re-arranging the first floor accommodation a formal staircase can be introduced to allow access to two rooms noted on the plans as a study and playroom along with a bathroom. All the rooms are lit by rooflights on the eastern elevation with cills at a height of 900mm. There are already habitable room windows on the eastern elevation and the closest dwelling to the east is some 20m away. As such the introduction of the rooflights will not significantly change the relationship of the properties with surrounding dwellings.
