A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister, after due consideration of the written report and the history of the application decided to refuse permission for the signs and to instigate enforcement proceedings to remove Sign 1, for the reasons given below.

Reason(s) for Decision:

The site, surrounding properties and Royal Square are Listed buildings and spaces of architectural and historic importance in Jersey. Sign 1 occupies a prominent position in this sensitive location. This fact, together with its size, and design is considered to have a disproportionate and detrimental effect on the host building, the adjoining property and the surrounding areas, contrary to Policies GD1, GD7, GD9 and HE1 of the Jersey Island Plan 2011, and Planning Advice Note no. 7 “Signs and Advertisements”.

Informative: The Minister raised no objection to Signs 2 and 3.

Recommendation

Refusal of permission and instigate enforcement proceedings to remove Sign 1. Advise that Sign 1 be relocated above the first floor windows on the north and west facing elevations.

 

Comments on Case

An application seeking retrospective permission for three signs was received in January 2011. The site is within the Built-Up Area, the building and adjoining buildings are Listed and Royal Square is a Listed Space.

 

Sign 1 - a vertical “Broadlands” name painted on to the side of the building facing into Royal Square, measuring 7.5m in length and extending from 1st to 3rd floor,

Sign 2 - a circular logo at 3rd floor on the corner of the building, approximately 1m in diameter, and

Sign 3 - business details painted on to the pillar at the entrance on Church Street.

 

The Historic Environment Team objected to Signs 1 and 2 because of the detrimental and dominant impact on the Listed Building and on Royal Square. The Parish of St Helier had no objection. An objection was received from the United Club above whose balcony Sign 1 is located.

 

The application was recommended for refusal and heard by the Minister, Freddie Cohen, at his request, in March 2011. He indicated that Sign 1 is inappropriately located, since it is not on a main façade, and is over-large. He considered it would be better located on the front of the building, as a horizontal sign above the first floor, thus moving it away from Royal Square. He considered Signs 2 and 3 to be acceptable. The formal decision was left pending receipt of amended plans and so the matter was deferred. The officer report is attached in full. This relates to the Policies of the 2002 Island Plan.

 

Email and phone call requests were made to the applicant between March and August, that Sign 1 be painted over and revised plans be submitted as discussed at the Ministerial Meeting. This was not acted upon so  an Enforcement Notice was served on the applicant on 16/08/11 for removal of Sign 1.

 

The date for compliance with this notice has now passed, but the matter cannot be taken further ie progressing it through the court, as the application is still live. The Minister is therefore requested to consider this matter and to act upon the course of action set by his predecessor by refusing planning permission, now related to the policies of the 2011 Island Plan, and instigate enforcement proceedings.
