Airport Duty Executive / Acting Airport Director.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): to appoint a fifth Airport Duty Officer / Acting Airport Director under Article 2 of the Aerodromes (Administration) (Jersey) Law 1952, as amended, to deputise for the Airport Director when the Airport Director is not on duty or out of the Island. The person so appointed shall, when so deputising have the same powers and be subject to the same duties as the Airport Director.

Reason(s) for decision:

The Minister for Economic Development has recognised that the Airport Director cannot be on duty 24 hours a day for every day of the year and has allowed him to appoint a number of Airport Duty Executive Officers / Acting Airport Directors. Mr Phil Wells no longer retains Powers due to his transfer to the Chief Minister’s Department.

Acting Airport Director’s and Airport Duty Executives will be Mr S Read, Mr J Snowdon, Mr J Buckley, Mr J Shilliday and Mrs Sandra Sawyer. Mr R Mayne takes on Airport Duty Executive duties but is now sworn in to taken on Acting Airport Director’s powers.

Action required:

Arrangements to be made for Mrs Sandra Sawyer to take Oath before the Royal Court as one of the officers appointed to depute for the Airport Director in pursuance of its powers under Article 2(2) and Article 2(3) of the Aerodromes (Administration) (Jersey) Law 1952, as amended, with effect from Friday 13 April 2007.

Under Article 2 of the Aerodromes (Administration) Jersey Law 1952, as amended,

“the Minister for Economic Development shall appoint a Chief Executive Officer to be called the Airport Director who shall be entrusted with the policing, control and administration of the aerodromes of the Island and shall perform such duties as may be imposed upon him by the Minister for the carrying into effect of any legislation for the time being in force relating to air navigation.

The Minister shall appoint one or more persons to deputise for the Airport Director when the Airport Director is not on duty and the person so appointed shall, when so deputising have the same powers and be subject to the same duties as the Airport Director.

The Airport Director and every person appointed under this Article shall, on appointment or as soon as may be thereafter take oath before the Royal Court well and faithfully to discharge the duties of their respective offices.”

The four officers who have taken oath before the Royal Court are:-

The Minister for Economic Development recognises that the Airport Director cannot be on duty 24 hours a day for every day of the year and has allowed him to appoint a number of Airport Duty Executive Officers. There are currently four Airport Duty Executive Officers (those listed above plus Mr R Mayne who has not be sworn in and cannot therefore be an Acting Airport Director) whose responsibilities broadly are as follows:

  1. An Airport Duty Executive Officer is appointed on a rostered basis so that a member of the Senior Management Team at Jersey Airport is available to deal with problems out of the normal office hours. He/she is contactable via a published telephone number or by cellphone at any time during his period of duty over a 24 hour period.
  1. He/she is authorised to open the Airport for ambulance flights or for other emergency movements.
  1. He/she is able to authorise extensions until 2230 hours local; only the Airport Director or his authorised deputy are empowered to extend Airport operations beyond 2230 hours as set out in P.83/99.
  1. He/she is authorised to make decisions when on duty covering a wide range of problems that do not require the express permission of the Airport Director, ie relieving the strain of passenger overcrowding during periods of delay, authorising overtime for tradesmen’s repairs/contractors’ work in an emergency, dealing directly with airlines, passengers and other organisations where that dealing directly will assist in the efficient operation of airlines and passengers.

With the restructure of Jersey Airport’s Executive Management Team of three Assistant Director’s reporting to the Airport Director, I propose to appoint Mrs Sandra Sawyer (Assistant Director Aviation Services) to be an Airport Duty Executive Officer/Acting Airport Director with effect from 13 April 2007.
