Motor Vehicle (Driving Licences) (Jersey) Order 2003: Amendments: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENTS TO THE MOTOR VEHICLES (DRIVING LICENCES) (JERSEY)

 

ORDER 2003

 

 

Purpose of the report

 

To gain the approval of the Minister for Transport and Technical Services for changes to the Motor Vehicles (Driving Licences) (Jersey) Order 2003 to introduce changes to the appearance of the photocard driving licence and add jurisdictions that have agreed to the mutual exchange of driving licences.

 

 

Discussion

 

There are minor amendments required to Schedules in the Motor Vehicles (Driving Licences) (Jersey) Order 2003 to:-

 

  1. Accommodate the parishes changing to laser engraving photocard licences, which is now a mandatory security requirement of the “Community Model Driving Licence”;

 

  1. Harmonise the position of the serial number of the licence (driver number) with the “Community Model Driving Licence”

 

  1. Add further jurisdictions that have agreed the mutual exchange of driving licences with Jersey.

 

SCHEDULE 4

 

PART 1- FORM OF LICENCE (NOT BEING A PROVISIONAL LICENCE)

 

On the illustration of the front of the licence, “4d” will be deleted.

 

On the index down the left hand side of the illustration of the reverse of the licence, “4d. Driver number” and “5. Number of licence” will be deleted and replaced with “5. Serial number of licence”.

 

PART 2 – FORM OF LICENCE (PROVISIONAL LICENCE)

 

On the illustration of the front of the licence, “4d” will be deleted and “PROVISIONAL” down the right hand side will appear in grayscale (laser engraved), instead of blue.

On the index down the left hand side of the illustration of the reverse of the licence, “4d. Driver number” and “5. Number of licence” will be deleted and replaced with “5. Serial number of licence”.

(i) Croatia has agreed to accept for exchange purposes Jersey driving licences and should be added in the correct alphabetical order with the columns entered in that entry as below:-

(iv) The new 3rd directive EU Community Model driving licences are beginning to appear with category A2 (motorcycle without sidecar, with a cylinder capacity of at least 400 cc, and an engine power of at least 25 kW) shown on them.   These motorcycles are currently category A in Jersey driving licences.  When resources are available to amend the Road Traffic (Jersey) Law 1956 and subject to the outcome of the Road Safety Strategy, it would be the intention to update Jersey licence categories and testing to include category A2.  However, with the formalisation of these vehicles in the 3rd directive we should include category A2 licence exchanges in the Order.  Therefore in the following entries for the EU and EEA countries in the Order there should be added in column 1 "A2" and in column 2 "A" :-  Austria, Belgium, Cyprus, Denmark, Finland, France, Germany, Gibraltar, Iceland, Ireland, Italy, Latvia, Liechtenstein, Malta, Netherlands, Norway, Poland, Portugal, United Kingdom.

 

 

Recommendation

 

The Minister is recommended to agree to the proposed changes to the Motor Vehicles (Driving Licences) (Jersey) Order 2003.
