Appointments Commission - Appointment of New Member.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Chief Minister approved the report and proposition recommending that Mr Julian Rogers be appointed as a member of the Appointments Commission for a term of 4 years.

Reason(s) for Decision:

A vacancy for a member of the Appointments Commission has arisen following the expiry of the term of office of a former member.  

An appointment process has been completed in accordance with the requirements of the Employment of States of Jersey Employees (Jersey) Law 2005 and has resulted in Julian Rogers being selected as a suitable replacement member for a term of office of 4 years.

In accordance with Article 18 (1) of the Employment of States of Jersey Employees (Jersey) Law 2005, which is concerned with the appointment of Commissioners to the Jersey Appointments Commission, to appoint Mr Julian Rogers as a new Commissioner for a period of 4 years.

REPORT  
 
 

Under the Employment of States of Jersey Employees (Jersey) Law 2005, Part 4, The Jersey Appointments Commission is established. The Commission consists of a Chair person and not more than 4 other commissioners. The purpose of this report is in reference to paragraph 18 (2) of this Law and the Chief Minister’s recommendation to the States of Jersey that Mr Julian Rogers be appointed by the States to the role of Appointments Commissioner with immediate effect. 

Background  

Currently the Jersey Appointments Commission comprises of: 

Mr Michael Liston – Chairman

Mrs Catherine Elizabeth Rees – Vice Chair

Mr Brian Curtis

Mr Kenneth Soar

Advocate Rose Colley’s term of office expired at the end of February 2009.  

A competitive appointment process was undertaken which complied with the Appointment Commission’s Code for Recruitment to Autonomous and Quasi-Autonomous Bodies and Tribunals. The vacancy was advertised in Jersey.  

The selection was undertaken by Deputy John Le Fondre, Assistant Minister, Chief Minister’s Department; Mr Ian Crich, in his capacity as Executive Officer to the Commission and Mr Mike Liston, Chairman of the Appointments Commission.  

Mr Rogers was interviewed on 4 March 2009 and assessed against the role description and person specification for an Appointments Commissioner. He was assessed as suitable. 

Mr Julian Rogers, MA, MBA has been resident in Jersey since 1975 and owns

and runs a software company working with a wide range of clients. His past

achievements include developing and running the first local adult IT Training

courses for business studies with the Education service. Mr Rogers has

given his services in the voluntary sector and has been Chairman of

the States Members Remuneration Body since 2004 and held roles

with the University of the Third Age, Jersey and The Probus Club of Jersey

and is a Yacht master with Raleigh Sailing. 

The States Employment Board approved the appointment of Mr Rogers for a term of 4 years. 

Thanks are extended to the retiring Commissioner, Advocate Colley, for her 7 years service with the Jersey Appointments Commission.
