Historic Building Register - assessment of St. Juste, St. Saviour

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): St Juste, St Saviour shall be added to the Historic Buildings Register as a Building of Local Interest.

Reason(s) for decision: In accordance with the strategic objective ‘to protect the best of the Island’s architectural heritage’ of the Island Plan 2002, and Policy HB1 of the Interim Policies for the Conservation of Historic Buildings St Juste, Belvedere Hill, St Saviour satisfies the published criteria for registration as a Building of Local Interest.

the criteria for inclusion in the Register - with the appropriate registration grade properly assessed once an internal inspection had been undertaken.

It was further concluded that the later nineteenth century extensions and additions to the octagonal cottage, and the modified lean-to cottage in the garden, do not possess sufficient historic or architectural interest to merit inclusion on the Register.

These conclusions were presented for discussion by JHAP at its meeting on 10 April 2006. The Panel carried out a detailed internal and external inspection of the property and noted that some features survive to the interior of the cottage - such as a small dog-leg staircase and doors - but that other significant features such as fireplaces have been lost. The Panel concluded that the interest of the cottage does not extend substantially to its interior and agreed with the recommendation that the octagonal cottage should be added to the Register as a BLI. It further agreed that other buildings on the site do not meet the criteria for registration.

Recommendation

The octagonal cottage at St Juste should be added to the Historic Buildings Register as a Building of Local Interest.

Reason(s) for Decision

The octagonal cottage at St Juste satisfies the published criteria for registration.

The registration of the octagonal cottage at St Juste is in accordance with Interim Policy HB1 which states ‘Historic buildings which contribute positively to the distinctive character or appearance of Jersey’s built-up areas or countryside, particularly where they are of ‘group value’, will be identified and included in the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey.

The registration of the octagonal cottage at St Juste is in accordance with the Interim Policy selection criteria which states ‘Any building which survives in recognisable form from before the middle of the nineteenth century will normally be of registerable quality for its historic interest, as well as, normally, meeting at least one of the other principal criteria’.
