Jersey Police Complaints Authority - Appointment of two new members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Jersey Police Complaints Authority - appointment of two new members.

Decision(s): The Minister agreed to recommend to the States the appointment of two new members of the Police Complaints Authority for a period of three years from 1 January 2010.

Reason(s) for Decision: The period of office of one member of the Police Complaints Authority is due to expire on 31 December 2009.  This member does not wish to be re-appointed for a further term.  The current Deputy Chairman of the Authority has been appointed to the post of Chairman with effect from the 1st January 2010 and it is therefore necessary to fill these two vacant posts.  The posts have been advertised, and following an interview process, Mr Bruce Ridley and Advocate Jane Martin have been identified as suitable candidates, and have been offered the posts, subject to approval by the States.

Action required: The Executive Officer, Home Affairs, to request the Greffier of the States to lodge the attached report and proposition ‘au Greffe’ at the earliest opportunity.

PROPOSITION  

THE STATES are asked to decide whether they are of opinion  

in accordance with Article 2 of, and the Schedule to, the Police (Complaints and Discipline) (Jersey) Law 1999 -  

to appoint the following as members of the Jersey Police Complaints Authority for a period of three years, effective from 1st January 2010 -  

Mr Bruce Lawrence Ridley

Advocate Jane Martin  
 
 

MINISTER FOR HOME AFFAIRS

 

REPORT  

The Jersey Police Complaints Authority is the independent body which was established in order to deal with police complaints matters.  Their role is to oversee investigations and make recommendations as to whether or not a matter should proceed to a disciplinary hearing.  They do not conduct disciplinary hearings because Police disciplinary hearings are conducted within the Police Force itself. 

The 3 year tenure of office of Mrs Toni Roberts, one of the members of the Jersey Police Complaints Authority, is due to come to an end on the 31st December 2009.  Mrs Roberts does not wish to be re-appointed for a further term.  Mr Thomas Slattery, the current Deputy Chairman of the Authority, has been appointed to the post of Chairman, with effect from 1st January 2010.  It is therefore necessary to fill the two posts which will become vacant at the end of this year. 

The positions were advertised in the Jersey Evening Post, and following an interview by a panel comprising the Chief Officer, Home Affairs, the Chairman (designate) of the Jersey Police Complaints Authority, a Human Resources Manager for Home Affairs, and a representative of the Jersey Appointments Commission, the positions were offered to Mr Bruce Ridley and Advocate Jane Martin.  Their appointment would be effective from 1 January 2010 for a period of three years.    
 

The Minister recommends that the following persons be appointed to serve on the Jersey Police Complaints Authority for a period of three years –  

Mr Bruce Lawrence Ridley  

Mr Ridley is currently a Director with one of the largest information technology companies in the Island.  He has previously held posts as the Deputy Managing Director of another large IT company; and as the Operations and Information Services Manager for the States of Jersey.  He has also been a Committee member of PADA (Parents Against Drug Abuse) and Treasurer for Jersey Cancer Bacup.   

Advocate Jane Martin  

Advocate Martin has been a Jersey Advocate for over 20 years, and until 2008 was the Managing Partner in a local law firm.  She completed her Law Degree at Exeter University, and has worked in some of the largest legal firms in the Island. Advocate Martin has been on the Board of Examiners for the Jersey professional law exams, a panel judge for the Jersey Enterprise Awards; and is also a member of the Board of Governors of the Jersey College for Girls/JCG Preparatory School. 
 

There are no additional financial or manpower implications arising from this proposition.
