Jersey Arts Trust: Budget Transfer from Economic Development and Chief Minister's Departments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Ministerial Decision Report

Budget transfers from the Economic Development Department and Chief Minister’s Department to Education, Sport and Culture for the Jersey Arts Trust

  1. Purpose of Report

To enable the Minister for Education, Sport and Culture (ESC) to approve non-recurring budget transfers in 2013 of £20,000 from the Economic Development Department (EDD) and £20,000 from Chief Minister’s Department (CMD) to ESC to fund cultural diplomacy initiatives for the benefit of Jersey’s international profile.

  1. Background

Following a meeting with the Chief Minister and Treasury and Resources Minister in October 2012 the Jersey Arts Trust has been in discussions with all relevant departments about the importance of cultural diplomacy and artistic activity to Jersey’s strategy and its potential benefits for Jersey’s international profile. These discussions particularly resonated with the External Affairs Division of the Chief Minister’s Department and Economic Development Department resulting in funding of £20,000 from each to pursue this area of work.

The Jersey Arts Trust plans to use these funds to further understand the potential for cultural diplomacy and international relations between artists through a mixture of research, meetings and test projects, which will either target certain jurisdictions and/or trial a formula for working that could be useful in the future. Half of the funds will be used to fund additional administration that will allow the Director of the Jersey Arts Trust to focus more on this area of work and half on small-scale projects.

The expected breakdown is as follows:

                                £

Artist Lock-In Pilot Project at Elizabeth Castle

    6,000

Interactive Project with France

    4,000

Community Arts Project Summer 2014

  10,000

Administration

  20,000

Total

  40,000

Transfer of funds to Jersey Arts Trust

Once the funds are received by ESC, these will be transferred to Jersey Arts Trust straight away and thus will be effectively fully spent by ESC in 2013.

Source of funds from EDD and CMD

The £20,000 funding from each of EDD and CMD will come from underspends.

  1. Recommendation

The Minister is recommended to approve non-recurring budget transfers in 2013 of £20,000 from each of the EDD revenue head of expenditure and CMD revenue head of expenditure to the ESC revenue head of expenditure for the benefit of the Jersey Arts Trust.

  1. Reasons for Decision

To enable the Jersey Arts Trust to further understand the potential for cultural diplomacy and international relations between artists through a mixture of research, meetings and projects with the aim of raising Jersey’s international profile.

  1. Resource Implications

The EDD revenue head of expenditure and CMD revenue head of expenditure will decrease by £20,000 each in 2013 and  the ESC revenue head of expenditure will increase by £40,000 in 2013. This decision does not change the total amount of expenditure approved by the States in the Medium Term Financial Plan 2013 to 2015.
