Waste Management (Jersey) Law 2005: Amendments: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the legislative drafting request for amendments to the Waste Management (Jersey) Law 2005, in light of the United Kingdom leaving the European Union in March 2019.

Reason(s) for Decision:

To continue to implement Jersey’s international obligations correctly in order not to jeopardise the UK’s ratification on Jersey’s behalf and to thereby continue to be able to export wastes which could not be dealt with effectively on the Island.

Approval to request legislative drafting for amendments to the Waste Management (Jersey) Law 2005, in light of the United Kingdom leaving the European Union in March 2019

 

Purpose of the Report

 

For the Minister to request legislative drafting time to make amendments to the Waste Management (Jersey) Law 2005 (‘Waste Law’), in light of the United Kingdom’s (UK) decision to exit the European Union (EU). 
 

Background

 

Jersey’s Waste Law was established to allow the UK to ratify the Basel Convention on Jersey’s behalf in order that, principally, the Island could export those wastes which could not be dealt with effectively on the Island. 

 

The UK’s decision to leave the EU means that the Waste Law needs to be amended to continue to implement the requirements of the Basel Convention and the OECD Decision which is essential for the Island. 

 

Details
 

The Waste Management (Jersey) Law 2005 is the legal basis of the UK’s ratification of the Basel Convention on Jersey’s behalf. This provides a way for Jersey to lawfully export those hazardous and other wastes that need specialist disposal technologies for which it is not economically viable for Jersey to build or invest in. The Law is encompassed within the Environment Chapter of the UK’s Accession Treaty and not Protocol 3.

 

References within the Waste Law to ‘member state of the European Union’ will no longer include the UK after 29 March 2019 when the UK leaves the EU.   Amendments to the Waste Law are therefore necessary to continue to implement the requirements of the Basel Convention and the OECD Decision correctly as they relate to the timing of decisions regarding the import, export or transit of waste.

The Minister is recommended to request legislative drafting time for amendments to the Waste Management (Jersey) Law 2005.
