Emergency Powers and Planning (Jersey) Law 1990: Competent Authority for Food Orders: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

The overall purpose of these Orders, to be made by the Competent Authority for Food under the Emergency Powers and Planning (Jersey) Law 1990, is to allow the Minister to (i) require the Government to keep a list of Jersey food businesses, (ii) request contact details from food businesses for use in an unfolding emergency (the appointment of an ‘Emergency Contact’ for this purpose); (iii) require retailers, wholesalers and producers to provide information on current stock levels of key food products, and; (iv) temporarily prohibit sales or release of food products by retailers, wholesalers and producers.

Decision(s):

The Minister approved the drafting instructions for these Orders under the Emergency Powers and Planning (Jersey) Law 1990 and has directed that the instructions should now be passed to the Law drafting Officers to prepare the Orders.

Reason(s) for Decision:

These Orders will come into force only after approval by the Emergencies Council. In planning for the range of possible emergency scenarios in which the Orders would be of use to the Minister in his capacity as the Competent Authority for Food it is clear that in each of these scenarios time is of the essence. It is therefore necessary to draft these Orders before any such emergency arises.

Resource Implications:

There are only very limited manpower and resource implications for EDTSC arising from this decision, these being that EDTSC will be compelled to maintain a schedule of food businesses operating on Jersey.  This is already done, in other formats, through for example Trading Standards.

Action required:

Legislative Drafters are requested to create the Orders as set out in the details within the Legislative Drafting Instructions.
