Langford South Car Park: Approval of drawings and acceptance of tender

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

3.2 (a)(x).

Subject: Langford South Car Park- Approval of Drawings and Acceptance of Tender (RFo 75)

Decision(s): 

(a)     In accordance with paragraph 1 (d) of Standing Order 168, the Assistant Minister, under delegated authority, approved the Architect’s Dwg Nos 4825/05D, 4825/06 and 4825/07, Structural Engineer’s Dwg Nos 11190/201C, 11190/205B and 11190/206, and Landscape Architect’s Dwg Nos LANG-10-01 and LANG-10-02  all showing the proposed works to the Langford South Car Park.

 

(b)     The Assistant Minister approved the acceptance of the lowest fixed price tender submitted by A.C Mauger & Son Limited in the sum £167,527.00  to undertake the works at the Langford South Car Park and enter in to a formal JCT Building Contract with A.C Mauger & Son Limited.

Reason(s) for Decision: 

The drawings noted in item (a) above and which planning and bye-law approval have been granted (Permit Nos P/2010/0017 and  B/2010/0574 refer)

Under Standing Order 168(1)(d) and 168(2)(b), it is a requirement for the Treasury Minister to approve of plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States. 
 

The estimated total cost for the works at the Langford South Car Park (including the lowest tender received, professional fees and ‘other’ costs), as designed, can be completed within the allocated budget.

The lowest fixed price tender submitted by A.C Mauger & Son Limited in the sum £167,527.00 can be accepted and a contract entered in to.

Resource Implications: 

Other than those noted in the report, there are no further financial or manpower implications.

Action required: 

The Assistant Director - Finance and Investment to sign the contract and other associated documentation.
