2007 Year-end budget transfers.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister approved the following transfers between heads of expenditure:

  • £20,162 from the Viscount’s Department to Home Affairs
  • £1,220 from the Viscount’s Department to the Dean of Jersey
  • £32,656 from the Viscount’s Department to the Data Protection Commission
  •  

Reason(s) for Decision:

To enable budget transfers to be made to ensure that no department is overspent at the end of 2007.

Resource Implications: 

There are no additional financial or manpower implications for the States or department as a result of this decision.

Action required: 

Head of Decision Support to ensure that appropriate budget transfers are made.

  1. Purpose of Report

To enable the Minister for Treasury and Resources to approve a number of budget transfers. 

  1. Background

The Public Finances (Jersey) Law 2005 does not permit any department to withdraw more from the consolidated fund than has been approved by the States as its head of expenditure. In practice the Council of Ministers manages any spending pressures by transferring budgets from departments that have underspent. At the end of 2007 three departments had overspent (all with the prior knowledge of the Council of Ministers):

At its meeting of 6th March the Council of Ministers agreed to transfer budgets equal to those overspends from the Viscount’s Department (which had an underspend of £655,274) to the relevant departments. 

  1. Recommendation

That the Minister approves the 2007 year end budget transfers as detailed above. 

  1. Reason for Decision

To enable budget transfers to be made to ensure that the Council of Minister’s assurances are honoured in terms of those departments they agreed to support should their reported projected overspends materialise.
