Draft Postal Services (Jersey) Law 2004 Appointed Day No.2

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made to approve the draft Appointed Day Act No. 2 for the remaining provisions of the Postal Services (Jersey) Law 2004.

Decision(s):

The Minister approves the coming into force of those provisions of the Postal Services (Jersey) Law 2004 that have not so far come into force, except Article 33 which is now redundant and directs the Projet and attached Report to be lodged ‘au Greffe’.

Reason(s) for decision:

The Minister needs to approve the Draft Appointed Day Act No.2 to bring into force the remaining provisions of the Postal Services (Jersey) Law 2004 so that Jersey Post may incorporate and operate in a commercial manner.

This decision needs to be taken simultaneously with that of the Treasury and Resources Minister to approve and lodge the Postal Services (Transfer) (Jersey) Regulations 200-.

Action required:

i) The report is to be sent to Angela Rayson, Publications Editor, States Greffe, for inclusion in the draft Projet.

ii) The final integrated document (including new projet number and updated explanatory note) is to be approved by Chris Anderson, Assistant Law Draftsman, prior to lodging.

iii) Projet is lodged.

iv) Richard Bell, Head of Corporate Financial Strategy, Treasury and Resources, and Chief Executive Officer of Jersey Post to be informed.

v) Advise Greffe this is to be lodged on Tuesday 31st January 2006.

vi) Request that this is debated in the States on Tuesday 14th March 2006.

Draft Postal Services (Jersey) Law 2004 (Appointed Day) (No. 2) Act 200-

REPORT

This draft Act will have the effect of bringing fully into force the new arrangements for postal services in Jersey set out in the Law. The planned date of 1st April 2006 has been agreed in principle with the Treasury and Resources Minister because it is vital that the staff, assets and liabilities of the present Economic Development Minister are also transferred on that date. The Treasury and Resources Minister is expected shortly to lodge the Draft Postal Services (Transfer) (Jersey) Regulations 200- for debate by the States on the same day as it debates this draft Act.
