Financial Report for the period ending 31 March 2006.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

PLANNING AND ENVIRONMENT

quarterly financial report for the period ending 31st march 2006

Purpose of the Report

The purpose of this report is to advise the Minister for Planning and Environment of the department’s financial position for the period ending 31st March 2006 (Financial Summary attached as Appendix A).

Discussion

Planning and Environment - Financial Overview

As at the 31st March the Planning and Environment Department was £307,579 overspent against its revenue budget. The reason for this overspend is due to budget profiling i.e. the budgets are not detailed in the month where expenditure is currently incurred. The Finance Department is currently trying to correct all budget profiling so that it can report accurately to the Minister spend to date against budget.

The Minister will see from the financial forecast that at the end of March, the Department is forecasting a projected overspend for 2006 of £351,601. The main reason for this is due to the decision of the Council of Ministers that the central contingency for VR/VER's is no longer available, and all VR/VER's to be funded henceforth from within department's cash limit. This has caused the department a short-term funding issue as its had to fund three VR/VER’s, amounting to £318,000, due to the fact that its staff budget has been reduced as part of the 2006 and 2007 FSR Service Reductions.

The Accounting Officer will make every effort to ensure that this forecast overspend is not realised by reprioritising service areas net revenue budgets so that the department meets it 2006 cash limit . If these savings can not be achieved in 2006 the department may have to use its 2006 Minor Capital allocation to fund its forecast overspend.
