Transfer of Joint Emergency Services Workshop

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved:

· The transfer of four Fire & Rescue Service Joint Emergency Services Workshop (JESW) posts from Home Affairs Department to Transport and Technical Services Department (TTS).

· The sale and transfer of JESW assets to TTS with each of the emergency services concluding these independently.

· The signing of a Service Level Agreement between the States of Jersey Fire and Rescue Service and the States of Jersey Ambulance Service, which will govern the type, quality and timeliness of fleet management and maintenance services delivered.

Reason(s) for decision:

To enable the completion of the final phase of the corporate project to provide engineering and fleet maintenance services from a single point.

Action required:

The Minister authorised the Chief Fire Officer to implement:

· The transfer of four Fire & Rescue Service JESW posts from Home Affairs Department to Transport and Technical Services Department.

· The sale and transfer of JESW assets to TTS, with each of the emergency services concluding these independently.

· The agreement for the levels of service that will be delivered under the new arrangements and signing off a Service Level Agreement between the States of Jersey Fire and Rescue Service and the Transport and Technical Services Departments.

Transfer of Joint Emergency Services Workshop (JESW) Staff and Sale of Workshop Assets To Transport & Technical Services Department

The Minister will be aware that the emergency services (Ambulance, Fire & Rescue and Police Services) have been working together for some time with the Transport & Technical Services (TTS) Department to transfer the responsibility for the management and maintenance of our fleets, plant and equipment to TTS’s engineering facilities.

The maintenance etc. of Fire & Rescue assets will move from the current JESW at Thorp House to the engineering facility at Bellozanne. The maintenance etc. of Ambulance and Police assets will move from the current JESW at Thorp House to a new satellite engineering facility within the Ambulance HQ complex. Thorp House is due for demolition in early 2007 as part of the new Police HQ building project.

In June 2006, in advance of the above moves, the responsibility for the line management of JESW staff was transferred to TTS and that department’s headcount increased accordingly. As JESW staff have always been part of the Fire & Rescue Service’s total head count, our formal establishment has also been adjusted accordingly. No financial resources (e.g. salaries, Social Security and Pension Contributions) have been transferred as these finances will remain within each of the emergency services’ revenue budgets and be used to cover the ongoing costs of receiving the T&TS services.

Ministerial Approval Required

(a) In reviewing my records I find that I failed to seek the Minister’s formal approval for the staff transfers and I would therefore ask that the moves receive retrospective approval.

(b) In addition to the staff transfers negotiations are currently taking place for the sale and transfer of JESW assets (e.g. maintenance equipment, vehicle spares, tyre stocks etc.) to T&TS and I would like Ministerial approval for each Service to conclude these independently.

(c) Approval for the signing by the Chief Fire Officer, or Chief Officer, of a Service Level Agreement between the States of Jersey Fire and Rescue Service and the Transport and Technical Services Department which will govern the type, quality and timeliness of fleet management and maintenance services delivered.
