Transfer of Functions from Chief Minister to Minister for Economic Development: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision and reason for the decision

The Chief Minister approved the transfer of functions in respect of digital policy and the Jersey Innovation Fund to the Minister for Economic Development, Tourism, Sport and Culture. This includes responsibility for:

  • Digital economy 
  • Data protection- legislation and policy
  • Data protection- internal compliance
  • Broadcasting
  • Telecommunications
  • Cyber security policy
  • Office of the Information Commissioner
  • Digital Jersey

The Chief Minister approved the instruction of the Principal Legislative Drafter to prepare an Order to transfer the associated legislative functions.

The Chief Minister also approved the appointment of Senator L. J. Farnham, Minister for Economic Development, Tourism, Sport and Culture, as Deputy Chief Minister, as notified in the Council of Ministers Minutes of 12 December 2018.

Resource implications

Legislative drafting time will be required to prepare the Order. There are no other resource implications.

Action required

The legislative drafting instructions to be sent by the Ministerial Support Unit to the Principal Legislative Drafter.

The Greffier of the States is requested to arrange for a report informing States Members of Senator Farnham’s appointment as Deputy Chief Minister to be submitted to the States.

Appointment of Deputy Chief Minister

 

REPORT

Under Article 24(1)(a) of the States of Jersey Law 2005, the Chief Minister shall appoint one of his Ministers to be Deputy Chief Minister.

 

In accordance with Article 27(1) of the States of Jersey Law 2005, the Deputy Chief Minister will discharge the functions of the Chief Minister during –

 

(a) the temporary absence or incapacity of the Chief Minister; or

(b) a vacancy in the office of Chief Minister.

 

On 24 January 2019, the Chief Minister acting in accordance with Article 24(1)(a) of the States of Jersey Law 2005 made a Ministerial Decision (MD-C-2019-0009, available at www.gov.je) appointing Senator L. Farnham, Minister for Economic Development, Tourism, Sport and Culture, as Deputy Chief Minister.
